Section 106 Templates

These templates contain the framework for the agreement, depending on which parties are involved:

· We and the owner/developer of the land will always be involved.

· Oxfordshire County Council will be involved if the agreement concerns county functions such as education or highways.

· If the owner has a mortgage on the land, the mortgagee (lender) will need to join in the agreement.

This is not an exhaustive list. The developer and the owner of the land may not be the same person, in which case both will need to join in the agreement. Or there may be tenants or lessees who need to be included.

The templates can be found below. Our templates are made available so that applicants can see the kind of document that they will be required to sign. However, these are complex legal documents and may be amended depending on the circumstances of the specific application and type of development. Changes may be made to the template accordingly and as the Council continually seeks to improve its templates. As such the templates are a good starting point, however the Council will continue to draft the Agreement to ensure the document is accurate and clearly sets out the relevant planning obligations pertaining to your application and development sought. You are strongly advised to seek independent legal advice before entering into an agreement of this kind.

Where Biodiversity Net Gain (BNG) is the only planning obligation, use the BNG S106 Agreement Template.

Where there are other planning obligations in addition to BNG, the BNG Schedule is to be inserted into the Schedules of the Section 106 Agreement.
