Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, J004716-DD-02, J004716-DD-03, J004716-DD-04 and J004716-DD-01, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The materials to be used for the external walls and roofs shall be agreed under application P24/S0197/DIS, unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The proposed windows at first floor level in the north east elevation of Plot 1 and at first floor level in the north east and south west elevations of Plot 2 and 3, shall be glazed in obscure glass, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the accommodation and it shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse or incidental buildings described in Schedule 2, Part 1, Classes A and E of the Order shall not be undertaken without the prior written permission of the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.

No development above slab level shall commence until a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hard standings, and the provision of boundary fencing and screen walling has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented as approved prior to the first occupation of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies DES1, DES2, and ENV1 of the South Oxfordshire Local Plan 2035.

The tree protection details as agreed under application P22/S1226/DIS shall be put in place and retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

The existing hedges on the land shall be protected whilst development operations are in progress, in accordance with the scheme agreed under application P22/S1226/DIS. Reason: To safeguard hedges which are visually important in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be implemented strictly in accordance with the details contained within the Biodiversity Mitigation and Enhancement Strategy approved under application P22/S1226/DIS. Reason: To ensure that there is no net loss of biodiversity, in accordance with Policy ENV3 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of the development vision splays measuring 2.4 metres by 43 metres shall be provided to each side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be carried out in accordance with the surface water drainage details approved under application P22/S1226/DIS prior to the first occupation of the development hereby approved. Reason: To prevent pollution and flooding in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be carried out in accordance with the foul water drainage details approved under application P22/S1226/DIS prior to the first occupation of the development hereby approved. Reason: To prevent pollution in accordance with Policies INF4 and EP4 of the South Oxfordshire Local Plan 2035.

Prior to occupation of the development hereby permitted the proposed means of access onto the B4009 Lower Icknield Way, is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy TRANS of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with drawing no. J004716 DD-01 and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policy TRANS of the South Oxfordshire Local Plan 2035.

The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without the prior written permission of the Local Planning Authority. Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policy TRANS of the South Oxfordshire Local Plan 2035
