P24/S1290/DISNotwithstanding the details shown on drawing numbers P.101 Site Layout and P.111 Plot Boundary, the public footpath along the northern boundary of the site shall connect with and provide unobstructed access into the adjacent development parcel to the west (Cala site BEN1 Phase 2) and shall thereafter remain unobstructed.
Reason: To ensure the public footpath connects with and provides access to the adjoining land, and thus linking the development sites to the public right of way Benson Bridleway 10, as conveyed in the submitted Design and Access Statement in accordance with Policy DES1 of the South Oxfordshire Local Plan 2035.
No development above slab level shall take place until samples of the materials to be used for the amphitheatre seating hereby permitted has been submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, visibility splays shown on the approved plans shall be provided in both directions along the adjacent highway. Within the visibility envelopes, there shall be no obstructions whatsoever, including vegetation, above 0.6 metres above the adjacent carriageway channel edge. Thereafter, the visibility splays shall be permanently maintained free from obstructions at all times.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first use of the temporary construction access on Hale Road shown drawing no. 8210550/601 in the CTMP, the visibility splays shown on the drawing shall be provided in both directions along the adjacent highway. Within the visibility envelopes, there shall be no obstructions whatsoever, including vegetation, above 0.6 metres above the adjacent carriageway channel edge. Thereafter, the visibility splays shall be maintained free from obstructions at all times until the temporary construction access is no longer required.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
No development shall commence unless and until a certificate confirming the agreement of an Offsetting Provider to deliver a Biodiversity Offsetting Scheme, totalling a minimum of 1.94 biodiversity units, has been submitted to and agreed in writing by the Local Planning Authority.
The written approval of the Council shall not be issued before the certificate has been issued by the Offset Provider. The details of biodiversity enhancements shall be documented by the Offset Provider and issued to the Council for their records.
Reason: To compensate for the net loss of biodiversity resulting from the development by providing biodiversity enhancements off site in accordance with Policy ENV3 of the SOLP and paragraphs 174 and 180 of the NPPF.
Prior to development above slab level, an updated Figure 1 (Proposed location for wildlife bricks) of the supporting document entitled Material to Discharge Condition 7 (Bioscan UK Ltd, November 2021, Report Reference: E1883r3) shall be submitted to and approved in writing by the local planning authority. The updated plan shall reflect the layout of the approved scheme and not show fewer than:
1. Ten integrated bat boxes
2. Ten integrated swift bricks
3. Seventy eight bat access bricks
Thereafter, the development shall be implemented in accordance with the approved details with all biodiversity features provided prior to final occupation.
Reason: To secure the provision of biodiversity enhancements onsite, in accordance with Policy ENV3 of the SOLP and paragraphs 174 and 180 of the NPPF.
The tree protection details as shown on the approved Tree Protection Plan (Appendix 3 of the submitted Tree Survey, Impact Appraisal & Arboricultural Method Statement, Feb 2022, Venners Arboriculture) shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented in accordance with the mitigation measures set out in Section 5 of the submitted Noise Impact Assessment Hale Road Benson Prepared for: Thomas Homes Report Ref: 50-364-R1-2 Date Issued: 19th November 2021.
Reason: To safeguard the amenities of the occupiers of the proposed development in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.
