Partial demolition and extension to existing barn/outbuilding to form new residential annex ancillary to Phoenix Cottage for the accommodation of a family member/carer. Temporary permission for a static caravan on site for the duration of construction (additional arboricultural information received 23rd June 2021 and reduction in ridge height and windows as shown on amended plans received 9th July 2021 and details of bat boxes received 10th August 2021)
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 21_5837_06_20_TPP_V2, JPCN PL 02, JPCN-PL-01-B, JPCN-MD-01-B and 4942-01, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order) the erection or construction of gates, fences, walls or other means of enclosure as described in Schedule 2, Part 2, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To prevent subdivision of the plot and to safeguard the character of the area in accordance with Policies DES1, and DES2 of the South Oxfordshire Local Plan 2035.
The tree protection details as shown on the approved Tree Survey and Arboricultural Impact Assessment (Date 18 June 2021) and shown on the Tree Protection Plan 21_5837_06_20_TPP_V2 shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented in strict accordance with the bat and bird nest box plan (UES, 10 August 2021, REF UES03431/01). Enhancements must be delivered prior to completion of the extension.
Reason: To achieve net gains for biodiversity, in accordance with ENV3 of the SOLP 2035 and paragraph 174 and 180 of the NPPF.
The developer shall confirm in writing to the Local Planning Authority the presence of any unsuspected contamination encountered during the development. In the event of any contamination to the land and/or water being encountered, no development shall continue until a programme of investigation and/or remedial works to include methods of monitoring and certification of such works undertaken. Where land contamination investigation/remedial works are required this must be carried out by a competent person in accordance with current government and Environment Agency Guidance and Approved Codes of Practice such as Land Contamination: Risk Management 2020 and BS10175:2011 +A2:2017 'Investigation of potentially contaminated sites' and submitted to and approved in writing by the local planning authority.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Phoenix Cottage.
Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.
