The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P21/S1984/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, SB-20-05 Rev C, SB-20-02 Rev C, SB/21/06, SB-20-03 Rev C, 6620-4, SB-20-04, 6620-1, SB-20-01 Rev A and SB-001-3D, and materials schedule received 9 February 2021, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies. Related application(s): P21/S1984/DIS

The exterior of the development hereby permitted shall only be constructed in the materials specified on the submitted materials schedule hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The tree protection measures shown within the submitted BS5837:2012 Tree Survey, Arboricultural Impact Assessment and Arboricultural Method Statement (December 2020) and shown on the submitted Tree Constraints and Protection Drawing, shall be put in place prior to any on site works and development (including demolition of the existing dwelling) and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

No development shall commence on site (other than demolition of the existing dwelling) without the appointed archaeologist being present (other than in accordance with the agreed and submitted Written Scheme of Investigation). Once the watching brief has been completed its findings shall be reported to the Local Planning Authority, as agreed in the Written Scheme of Investigation, including all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication which shall be submitted to the Local Planning Authority within two years of the completion of the archaeological fieldwork. Reason: To enable an appropriate level of archaeological investigation of the area including excavation and recording, post excavation analysis and the publication of results in accordance with Policy ENV9 of the of the South Oxfordshire Local Plan 2035.

Prior to first occupation, all carbon reduction energy efficiency measures shall be implemented in accordance with the Energy Statement (dated 15 December 2020) hereby approved and a Verification Report shall be submitted to the Local Planning Authority and approved in writing. The Verification Report shall demonstrate (with photographic evidence) that the energy efficiency measures have been implemented. These measures shall be retained and maintained as such thereafter in accordance with the Energy Statement and Verification Report. Reason: To ensure high standards of sustainable design and construction in accordance with Policy DES10 of the South Oxfordshire Local Plan 2035.

The foul and surface water drainage scheme shall be implemented in accordance with the approved details on drawing SB/21/06 and in the Drainage Report received 5 February 2021, prior to the first occupation of the development hereby approved. Reason: To prevent pollution and flooding in accordance with Policies ENV12, EP4 and DES8 of the South Oxfordshire Local Plan 2035 and policy NP30 of the the Benson Neighbourhood Plan 2018.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan SB-20-02 Rev C and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The first floor window in the north elevation of the dwelling hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight (or other means of opening to be first agreed in writing by the Local Planning Authority) prior to the first occupation of the accommodation and it shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be implemented strictly in accordance with the measures stated in section 5 of the Preliminary roost assessment (October 2020 by Elite Ecology). For avoidance of doubt this must include 1 x bat feature and 1 x bird box. The location of these shall be informed by an ecologist, implemented prior to first occupation of the dwelling and retained in perpetuity. Reason: To protect the important species on the site, in accordance with Policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035 and policy NP30 of the Benson Neighbourhood Plan 2018

The developer shall confirm in writing to the Local Planning Authority the presence of any unsuspected contamination encountered during the development. In the event of any contamination to the land and/or water being encountered, no development shall continue until a programme of investigation and/or remedial works to include methods of monitoring and certification of such works undertaken. Where land contamination investigation/remedial works are required this must be carried out by a competent person in accordance with current government and Environment Agency Guidance and Approved Codes of Practice such as Land Contamination: Risk Management 2020 and BS10175:2011 +A2:2017 'Investigation of potentially contaminated sites' and submitted to and approved in writing by the local planning authority. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the amenities of the occupiers of the adjoining properties, the rural hamlet character of the area and riverside views in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035 and policies NP7, NP27 and NP28 of the Benson Neighbourhood Plan 2018

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the enlargement of a dwellinghouse consisting of an addition or alteration to its roof as described in Schedule 2, Part 1, Class B of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the amenities of the occupiers of the adjoining properties, the rural hamlet character of the area and open riverside views in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035 and policies NP7, NP27 and NP28 of the Benson Neighbourhood Plan 2018

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the amenities of the occupiers of the adjoining properties, the rural hamlet character of the area and open riverside views in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035 and policies NP7, NP27 and NP28 of the Benson Neighbourhood Plan 2018

No building or raising of land levels shall take place within the site, other than in accordance with the approved plans. Reason: To prevent increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
