Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, D1 and H4 of the South Oxfordshire Local Plan 2011.
The first floor side-facing windows of Plots 3, 5, 7, 13, 14, 16, 17, 18, 19, 21, 22, 23, 25 hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the accommodation and it shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policies G2, D4 and H4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Extensions; Class B - Roof Extensions; Class E - Outbuildings; Class F - Hardstandings shall be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: The specific circumstances of the development hereby approved, with a higher density than adjacent built form adjacent to the Chilterns AONB, warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of the sensitive landscape setting, maintaining important trees and approved landscape features or compromise the minimum residential amenity standards that have been achieved by the approved layout in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 C4, C9, D1, D4 and H4 of the South Oxfordshire Local Plan 2011.
The access shall be constructed from Kennylands Road in accordance with drawing no. 4963.001 Rev C including any off-site highway works and clear visibility splays at 2.4 metres back from the edge of the main carriageway at the centre of the access to points 54m southbound and 56m northbound. The visibility splays shall be maintained as approved and not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level.
Reason: In the interest of highway safety in accordance with Policies G2, H4 and T1 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved, the whole of the estate roads and footpaths serving the constructed dwellings shall be laid out, constructed, lit and drained in accordance with the current version of Oxfordshire Residential Road Design Guide and thereafter maintained as approved.
Reason: In the interests of highway safety and to ensure a satisfactory standard of construction and layout for the development, in accordance with Policies G2, D2, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of any dwelling hereby approved, the parking and turning areas to serve that dwelling shall be constructed in accordance with the approved plan 2018/P0025/101/D and shall be constructed, laid out, surfaced, drained and completed to be compliant with the sustainable drainage (SuDS) details approved in association with Condition 22, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies G2, D2, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.
The development shall be constructed in accordance with the details of cycle parking as shown on drawing number 19.03-100 Rev D included in the approved plans list in condition 1 above.
Reason: To encourage the use of cycles as a means of transport in accordance with Policies G2, D2, H4 and T2 of the South Oxfordshire Local Plan 2011.
The Construction Traffic Management Plan (4963/CTMP Issue Status: 03) approved on 17/6/19 under application reference P19/S0909/DIS shall be implemented prior to any works being carried out on site, and shall be maintained throughout the course of the development.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
The Travel Plan (4963/TPS Issue Status: 01) approved on 17/6/19 under application reference P19/S0909/DIS shall be implemented upon occupation of the first dwelling and thereafter used to promote the use of sustainable transport and avoidance of the single occupancy use of the private car, the targets for this shall be specified according to SMART criteria. The first residents of each dwelling shall be provided with a copy of the approved Travel Information Pack. The Residential Travel Plan shall be monitored and reviewed in accordance with details to be set out in the approved plan.
Reason: To promote the use of non car modes of transport in accordance with Policy CSM2 of the South Oxfordshire Core Strategy 2027.
The carport/garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies G2, D2, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.
The scheme shown on the plan entitled Landscape Proposals drwgno 741 01 Rev E listed in condition 1 above shall be implemented prior to the first occupation or use of development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
Within three months of the date of this permission a landscaping scheme for the area between plots 17 and 18, at the south eastern end of the site shall be submitted to and approved in writing by the Local Planning Authority.
The approved landscaping shall be implemented prior to the first occupation of development and thereafter be maintained in accordance with the approved scheme. The measures set out in the Landscape Management Plan (LMP) 741KYLDSTAFLDS rev dated 14.10.19 approved on 16/10/19 under application reference P19/S1369/DIS shall be implemented in accordance with the agreed programme. For the avoidance of doubt, the measures included in the LMP shall also apply to the landscaping scheme required by condition 14 above.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
The tree protection details as shown on the approved tree protection plan 208-06/G contained within the Arboricultural Method Statement dated 10 September 2020 shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development construction.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9, D1 and H4 of the South Oxfordshire Local Plan 2011.
The biodiversity mitigation and enhancement measures in Biodiversity Mitigation and Enhancement Plan (Revision 2, 23/04/2019) approved on 17/6/19 under application P19/S0909/DIS and Landscape Proposals drwg no 741 01 Rev C received 19/9/19 and Landscape Management Plan 741KYLDSTAFLDSrev dated 14.10.19 approved on 16/10/19 under application number P19/1369/DIS shall be developed on site and retained in accordance with the approved details. All mitigation and enhancement measures should be delivered prior to the final occupation of the relevant phase.
Reason: To ensure the enhancements for habitats and species on the site are delivered in accordance with Policy CSB1 of the South Oxfordshire Core Strategy 2027, Policies G2, C6 and H4 of the South Oxfordshire Local Plan 2011 and Paragraphs 170 and 175 of the NPPF (2018).
The development shall be carried out in accordance with the approved details of the mitigation strategy for badgers, comprising Badger Sett Inspection Letter dated 11th February 2019 and Biodiversity Mitigation and Enhancement Plan (Revision 2, 23/04/2019) (subject to Figure 4 of the BMES being cited as the location of the CEZ) which were approved on 17/6/19 under application reference P19/S0909/DIS.
Reason: To protect the important species on the site, in accordance with provisions of the NPPF and Policies CSB1 of the South Oxfordshire Core Strategy 2027 and G2, C8 and H4 of the South Oxfordshire Local Plan 2011.
The hours of operation for construction and demolition works shall be restricted to 08:00-18:00 Monday to Friday and 08:00-13:00 on a Saturday. No work is permitted to take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority.
Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policies G2, EP2 and H4 of the South Oxfordshire Local Plan 2011.
The development shall proceed in accordance with the approved Dust Mitigation Statement received 19/03/19 and approved on 17/6/19 under application reference P19/S0909/DIS.
Reason: To protect the occupants of nearby residential properties from noise and dust disturbance during the development of the site in accordance with South Oxfordshire Local Plan 2011 Policies G2, EP1 and H4.
The street lighting layout and details shall be provided as shown on drawing number MMA15393-001 approved on 18/8/20 under application reference P19/S3412/DIS.
Reason: To protect the adjacent Chilterns AONB landscape, wildlife and local residents from light pollution in accordance with Policies G2, C4. C6, EP3 and H4 of the South Oxfordshire Local Plan 2011.
Within one month of the date of this decision, and prior to any drainage works on plots 12-15, full details of a sustainable surface water drainage system for the site shall be submitted in writing and approved by the Local Planning Authority. The design of the surface water drainage system shall be based on the investigations, design calculations, site level and management and maintenance plan approved under reference P19/S3412/DIS on 18 August 2020.Thereafter, the development shall be implemented in accordance with the approved details before the development is occupied.
Reason: To prevent pollution and flooding in accordance with Policies G2, EP1, EP4, EP6 and H4 of the South Oxfordshire Local Plan 2011.
Within one month of the date of this decision, and prior to any foul drainage works on plots 12-15, details of proposed foul water drainage for the site shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented in accordance with the approved details before the development is occupied.
Reason: To prevent pollution in accordance with Policies G2, EP1 and H4 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of any dwelling on the site hereby approved, a scheme to provide each dwelling with Electric Vehicle Charging Points shall be submitted to and approved in writing by the Local Planning Authority. Thereafter each Electric Vehicle Charging Points shall be implemented prior to the occupation of the dwelling it would serve.
Reason: To ensure sustainable forms of transport are provided in accordance with Policy CSQ2 of the of the South Oxfordshire Core Strategy 2027.
