Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 31 July 2023.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 4087-HEAT-ICS-01-XX-DR-C-0200-P03, 18022 - PP100 - D, 18022 - PE105 - B, 18022 - PE203 - C, 18022 - PE303 - B, 18022 - PP104 - B, 18022 - PP202 - B, 18022 - PP302 - B, 18022 - PP103 - B, 18022 - PP201 - B, 18022 - PP301 - B, HEA-P400-G, 18022 - PE102 - E, 18022 - PP101 - F and 18022 - LP010, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The surface water drainage scheme shall be implemented in accordance with the details submitted and approved in the condition discharge application P20/S3852/DIS.
Reason: To prevent pollution and flooding in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035 and Policy 15 of the Goring Neighbourhood Plan 2019
The foul water drainage scheme shall be implemented in accordance with the details submitted and approved in the condition discharge application P20/S3852/DIS.
Reason: To prevent pollution in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035 and Policy 15 of the Goring Neighbourhood Plan 2019
The development hereby approved, shall be implemented in accordance with the biodiversity enhancements strategy (BES) submitted and approved in the condition discharge application P20/S3852/DIS.
Reason: To compensate for the loss of habitat on site, in accordance with Policy ENV3 of the South Oxfordshire Local Plan 2035, Policy 12 of the Goring Neighbourhood Plan 2019 and paragraph 170 of the National Planning Policy Framework 2019.
No development or any site works including demolition shall commence until the tree protection details as shown in the approved Arboricultural Method Statement (Revised May 2020) and on the Tree Protection Plans submitted 7 July 2020 - 18022 - PP101 - E (Appendix 1 and Appendix 2) approved in application P20/S0017/FUL, have been implemented. Thereafter, the tree protection measures shall be retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035 and Policies 11 and 12 of the Goring Neighbourhood Plan 2019
The development hereby approved, shall be implemented in accordance with the bat mitigation class licence, specific to this development, from Natural England, as approved in writing by the local planning authority in the condition discharge application P20/S3852/DIS.
Reason: To protect the important species on site, in accordance with Policy ENV3 of the South Oxfordshire Local Plan 2035, Policy 12 of the Goring Neighbourhood Plan 2019 and paragraph 170 of the National Planning Policy Framework 2019
The materials to be used in the external construction and finishes of the development hereby permitted shall be those approved in the condition discharge application P20/S3852/DIS.
Reason: In the interests of the visual appearance of the development and responding to the character of the area in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035 and Policy 16 of the Goring Neighbourhood Plan 2019.
The development shall be carried out in the details of the minimising of light spillage in accordance with the approved details in the condition discharge application P20/S3852/DIS and thereafter implemented and retained in accordance with the approved details, prior to first occupation of the new dwellings hereby permitted
Reason: To ensure that reflection and light spillage is kept to a minimum to safeguard the landscape character of the area in accordance with Policies DES1, DES2, ENV12 and ENV1 of the South Oxfordshire Local Plan 2035 and Policies 02, 11,13 and 16 of the Goring Neighbourhood Plan 2019
The landscaping scheme as shown on the approved plan HEA-P400-G shall be implemented and completed prior to the first occupation of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies DES1, DES2, ENV1 and ENV5 of the South Oxfordshire Local Plan 2035 and Policy 11 and 16 of the Goring Neighbourhood Plan 2019.
The first floors windows in the side (east and west) elevations of the three dwellings hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the accommodation and it shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
Prior to occupation of the development hereby permitted the proposed means of access onto Elvendon Road is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the occupation of the development vision splays measuring 2.4 metres by 43 metres shall be provided to each side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 18022-PP101 F,and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies TRANS2 and TRANS5 of the South Oxfordshire Local Plan 2035.
Any section or part of the existing unauthorised close boarded fence erected around the site which does not accord with the approved hard and soft landscape scheme as shown in drawing P400 G shall be removed from the application site prior to first occupation of the dwellings hereby approved.
Reason: Reason: In the interests of the visual appearance of the development, character of the area and special AONB landscape in accordance with Policies DES1, DES2 and EVN1of the South Oxfordshire Local Plan 2035 and Policy 11 of the Goring Neighbourhood Plan 2019
The cill level of the two roof lights in the east elevation of plot 1 shall be at least 1.7 metres above the floor level of the associated rooms and shall be retained as such thereafter. No additional rooflights shall be inserted into the side (east and west) elevations of the development hereby approved without planning permission from the Local Planning Authority.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented in accordance with the measures stated in section 6 of the supporting Bat Survey Report (Ecology By Design Ltd, 09/10/2019, Project Code: EBD00931).
Reason: To minimise the impacts of development on, and secure net gains for, biodiversity in accordance with Policy ENV3 of the South Oxfordshire Local Plan 2035, Policy 12 of the Goring Neighbourhood Plan 2019 and paragraph 170 of the National Planning Policy Framework 2019
Any external lighting will only be permitted in accordance with a lighting scheme to be submitted to and approved in writing by the Local Planning Authority prior to the first occupation of the development hereby approved. Any such lighting shall be implemented in accordance with the approved details and directed downwards to prevent light spillage in Chilterns Area of Outstanding Natural Beauty
Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policies, DES6, ENV1 and ENV3 of the South Oxfordshire Local Plan 2035 and Policies 02, 11,13 and 16 of the Goring Neighbourhood Plan 2019.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity, high quality design, character of the area and special interest of the AONB landscape and in accordance with Policies DES2, DES6 and ENV1 of the South Oxfordshire Local Plan 2035, and Policies 02, 11 and 16 of the Goring Neighbourhood Plan 2019
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement of a dwellinghouse consisting of an addition or alteration to its roof as described in Schedule 2, Part 1, Class B of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity, high quality design, character of the area and special interest of the AONB landscape and in accordance with Policies DES2, DES6 and ENV1 of the South Oxfordshire Local Plan 2035, and Policies 02, 11 and 16 of the Goring Neighbourhood Plan 2019.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity, high quality design, character of the area and special interest of the AONB landscape in accordance with Policies DES2, DES6 and ENV1 of the South Oxfordshire Local Plan 2035, and Policies 02, 11 and 16 of the Goring Neighbourhood Plan 2019.
The garage accommodation hereby approved shall be retained for vehicular parking and shall not be adapted for living or other ancillary purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies TRANS" and TRANS5 of the South Oxfordshire Local Plan 2035.
