Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, PR 3D Rev A, EX EL1 Rev A, PR EL1 Rev A, PR EL2 1 Rev A, PR EL3 Rev A, EX EL2 Rev A, PR DE2 Rev A, EX GA2 Rev A, PR GA2 Rev A, EX GA1 Rev A, PR GA1 Rev A, EX GA3 Rev A, PR GA3 Rev A, PR DE1 Rev A, EX GA4 Rev A, PR GA4 Rev A, PR DE3 Rev A, EX OS Rev A and PR OS Rev A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
No development shall take place until a detailed scheme for protecting the dwellings from the external noise environment of the area [and from internal noise arising from any ventilation plant associated with the development] has been submitted to and approved in writing by the Local Planning Authority.
The scheme itself shall be designed, specified and constructed so that the sound insulation performance of the structure and the layout of the dwellings is such that the indoor ambient noise levels do not exceed the values detailed in Table 4 of BS 8233:2014 "Indoor ambient noise levels for dwellings". Thereafter the development shall not be carried out other than in accordance with such approved scheme which shall be completed before any part of the accommodation hereby approved is occupied, unless the Local Planning Authority otherwise agrees in writing.
Reason: To safeguard the amenities of the occupiers of the proposed development in accordance with Policies CS1 and CSHEN1 of the South Oxfordshire Core Strategy 2027 and Policies D5, EP1, EP2, G5 and H4 of the South Oxfordshire Local Plan 2011.
No development shall take place until a scheme for the control of noise from the building has been submitted to and approved in writing by the Local Planning Authority. Any equipment, plant or process provided or undertaken in pursuance of this condition shall be operated and retained in compliance with the approved scheme.
N.B. this condition is intended to control noise from the inside of the building and should consider noise control from points of access and egress - for example the proposed access points, sealing the building from internal noise, upgrading the acoustic specification of windows where necessary, ensuring that any ventilation points and entry for fresh air feeds are appropriately acoustically protected.
Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policies CS1 and CSHEN1 of the South Oxfordshire Core Strategy 2027 and Policies D5, EP1, EP2, G5 and H4 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby approved samples of the roof tiles and brickwork to be used for the external walls and roofs of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To secure proper planning of the historic environment and in the interests of the visual appearance of the development in accordance with Policies CS1, CSHEN1 and CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies CON2, CON3, CON4, CON5 and CON7 of the South Oxfordshire Local Plan 2011.
That the development hereby approved shall not commence until a detailed specification of the type, design and external finish of all windows and external doors has been submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details.
Reason: To secure proper planning of the historic environment and in the interests of the visual appearance of the development in accordance with Policies CS1, CSHEN1 and CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies CON2, CON3, CON4, CON5 and CON7 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby approved, joinery, construction and fixing details for the glazed atrium extension hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details.
Reason: To secure proper planning of the historic environment and in the interests of the visual appearance of the development in accordance with Policies CS1, CSHEN1 and CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies CON2, CON3, CON4, CON5 and CON7 of the South Oxfordshire Local Plan 2011.
Details, including drawings and schedule of works, materials and finishes as necessary, in respect of any upgrading, painting and making good of the existing commercial unit frontage, shall be submitted to and approved in writing by the Local Planning Authority before the relevant part of the work has begun. Thereafter the works shall be carried out in accordance with the approved details.
Please note any advertisement incorporated into the design will require a separate and concurrent application for advertisement consent.
Reason: To safeguard the special architectural or historic interest of the listed building and surrounding conservation area in accordance with Policies CS1, CSHEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy and Policies CON3, CON4, CON5, CON7, D1 and G2 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of any site works or operations relating to the development hereby permitted, an arboricultural method statement to ensure the satisfactory protection of retained trees during the construction period shall be submitted to and approved in writing by the Local Planning Authority. Written approval must be obtained prior to commencement of any site works including demolition. The matters to be encompassed within the arboricultural method statement shall include the following:-
(i) A specification for the pruning of, or tree surgery to, trees to be retained in order to prevent accidental damage by construction activities;
(ii) The specification of the location, materials and means of construction of temporary protective fencing and/or ground protection in the vicinity of trees to be retained, in accordance with the recommendations of BS 5837 'Trees in relation to design, demolition and construction' and details of the timing and duration of its erection;
(iii) The definition of areas for the storage or stockpiling of materials, temporary on-site parking, site offices and huts, mixing of cement or concrete, and fuel storage;
(iv) The means of demolition of any existing site structures, and of the re-instatement of the area currently occupied thereby;
(v) The specification of the routing and means of installation of drainage or any underground services in the vicinity of retained trees;
(vi) The details and method of construction of any other structures such as boundary walls in the vicinity of retained trees and how these relate to existing ground levels;
(vii) The details of the materials and method of construction of any roadway, parking, pathway or other surfacing within the RPA, which is to be of a 'no dig' construction method in accordance with the principles of Arboricultural Practice Note 12 "Through the Trees to Development", and in accordance with current industry best practice; and as appropriate for the type of roadway required in relation to its usage.
(viii) Provision for the supervision of ANY works within the root protection areas of trees to be retained, and for the monitoring of continuing compliance with the protective measures specified, by an appropriately qualified arboricultural consultant, to be appointed at the developer's expense and notified to the Local Planning Authority, prior to the commencement of development; and provision for the regular reporting of continued compliance or any departure there from to the Local Planning Authority.
Thereafter the development shall be carried out in accordance with the approved details with the agreed measures being kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies CS1, CSHEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C9, CON5, CON7 and G2 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of development a detailed plan showing provision for one car parking space to be accommodated within the site, shall be submitted to and approved in writing by the Local Planning Authority and such parking facilities shall be laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles in strict accordance with the approved details prior to the first occupation of the development hereby permitted. Thereafter the car parking spaces shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and to ensure the provision of off-street car parking in accordance with Policies D2, EP6, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of development a detailed plan showing provision of cycle parking facilities accommodated within the site, shall be submitted to and approved in writing by the Local Planning Authority and such parking facilities shall be laid out in strict accordance with the approved details prior to the first occupation of the development hereby permitted. Thereafter the cycle parking spaces shall be retained unobstructed except for the parking of bicycles associated with the development at all times.
Reason: To encourage the use of cycles as a means of transport in accordance with Policies D2, H4 and T2 of the South Oxfordshire Local Plan 2011.
