Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 17095.PP401, 17095.SU001, 17095.L01, 17095.TOPO, 17095.PE101b, 17095.PE201b, 17095.PP101b, 17095.PP201b, 117095-PP601, 17095-PP501, 17095.PP302c, BEN, 17095-IP002c, 17095.PS301c, Appendix 4 17095.PP301b, 3324-S4-TOKE-ICS-01-XX-DR-C-003-P2, 17095.PP301b, 3324-S4-TOKE-ICS-01-XX-DR-C-002-P2, 3324-S2-TOKE-ICS-01-XX-DR-C-005-P2, 3324-S4-TOKE-ICS-01-XX-DR-C-010-P2, 3324-S4-TOKE-ICS-01-XX-DR-C-012-P2 and 3324-S4-TOKE-ICS-01-XX-DR-C-004-P2, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Except in the case of the details shown on the approved plans, no change in the levels of the land shall take place unless in accordance with a detailed scheme which shall have been submitted to and approved in writing by the Local Planning Authority before any development commences on site. The scheme shall include details of existing and proposed ground levels.
Reason: To ensure a satisfactory form of development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, D1 and H4 of the South Oxfordshire Local Plan 2011.
The exterior of the development hereby permitted shall only be constructed in the materials specified in the schedule of materials submitted with the application hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: To safeguard the character of the area in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, D1 and H4 of the South Oxfordshire Local Plan 2011.
The first floor bathroom and en-suite windows in the north-facing elevation of Plot 1 and the first floor bathroom and en-suite windows in the south-facing elevation of Plot 2 hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the accommodation and it shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policies G2, D4 and H4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Classes A - Extensions, B - Roof Extensions, E - Outbuildings; F - Hardstandings shall be undertaken without the prior written permission of the Local Planning Authority.
Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, D1, D4 and H4 of the South Oxfordshire Local Plan 2011.
Prior to occupation of the development hereby permitted the proposed means of access onto Tokers Green Lane is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policies G2, H4 and T1 of the South Oxfordshire Local Plan 2011.
Before the proposed access is first used, the existing access onto Tokers Green Lane shall be permanently stopped up by the means of reinstatement of the highway verge and proposed planting to the approval of the Local Planning Authority and in accordance with the local highway authority's specifications. Thereafter the closed access shall not be used by any vehicular traffic whatsoever.
Reason: In the interest of highway safety in accordance with Policies G2, H4 and T1 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development vision splays measuring 2.4 metres by 33 metres shall be provided to each side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level.
Reason: In the interest of highway safety in accordance with Policies G2, H4 and T1 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with drawing no. 17095-PP301B and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies G2, D2, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.
The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies G2, D2, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.
Any gates provided shall be set back a minimum of 5.0 metres from the edge of the carriageway and shall open inwards into the site.
Reason: To ensure that vehicles may wait clear of the highway while the gates are opened or closed in the interests of highway safety in accordance with Policies G2, H4 and T1 of the South Oxfordshire Local Plan 2011.
The landscaping scheme as shown on the approved plan BEN dated 5th November 2018 shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, C9, D1 and H4 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of development, the tree protection measures as set out on the approved site plan 17095 - PP301B received 12th December 2018 and listed within the Arboricultural Method Statement (AMS) of the submitted Tree Survey Report shall be implemented before starting any on site works including demolition and thereafter shall be retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, C9, D1 and H4 of the South Oxfordshire Local Plan 2011.
The development hereby approved shall be implemented in accordance with the approved surface water and foul drainage details.
Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.
