Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That samples of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of all ground surfaces and details of any fences or freestanding walls and a scheme of maintenance shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings. That, within twelve months of the commencement of development, a hedge of a species to be agreed in writing by the Local Planning Authority shall be planted behind the vision splay adjacent to the boundary of the site with Oxford Road to extend and fill gaps in the existing hedge. The hedge shall be tended to grow to, and remain at, a height of not less than 3 metres, and that any plant which may die or be seriously damaged within five years of completion of the development shall be replaced and properly maintained. Reason: To help to assimilate the development into its surroundings. That the existing hedge along the boundary of the site with Oxford Road shall be retained and maintained at a height of not less than 3 metres. Reason: To help to assimilate the development into its surroundings. That the existing trees and hedges on the land shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development. Reason: To safeguard the character of the area. That before any of the development hereby permitted is occupied, the car and cycle parking and turning spaces shown on the approved plan shall be constructed and such spaces shall thereafter be kept permanently available for the use of employees and visitors to the site. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities. That details of all external lighting including fitments and levels of illumination shall be submitted to and approved in writing by the Local Planning Authority. Reason: To protect local amenities. That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: In the interests of public health. That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health and to avoid pollution. That the restaurant shall not open to the public until a footway has been provided between the site and the existing footway in Oxford Road in accordance with a scheme approved in writing by the Local Planning Authority. The footway link shall be kept open at all times that the restaurant is open to the public. Reason: To ensure safe and convenient pedestrian access from Benson.
