Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That, notwithstanding the details accompanying the application, details and samples of the materials to be used for all building and freestanding walls and for all roofs shall be submitted to and approved in writing by the Local Planning Authority before development commences.
Reason: To ensure that the details of the development are satisfactory.
That development shall not begin until a detailed specification of the type, design and external finish of all windows, external doors, windows, eaves/verges and rainwater goods has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory.
That a scheme for the landscaping of the site, including the planting of live trees and shrubs, details of all freestanding walls and fences, details of all ground surface treatments and any changes in land levels shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings.
That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing.
Reason: In the interests of public health.
That no soakaways shall be constructed such that they penetrate the water table and shall not be in any event exceed two metres in depth below existing ground level.
Reason: To prevent pollution of groundwater.
That no dwelling shall be occupied until Benson Footpath No 11 has been surfaced between Watlington Road and its points of access to the site in accordance with a scheme approved in writing by the Local Planning Authority.
Reason: To ensure a safe and convenient access for pedestrians.
That before any of the development hereby permitted is occupied, the parking and turning spaces shown on the approved plan shall be constructed and such spaces shall thereafter be kept permanently available for the use of residents and visitors to the site.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities.
That work be not commenced on the erection of any dwellings until the carriageways only serving the whole of that portion of the development under construction, have been laid out and constructed to the above mentioned specification, save for wearing course and kerbing.
Reason: In the interests of highway safety, to provide protection of the subgrade and to ensure adequate clear running surfaces which will protect adjoining public highways from droppings of spoil, mud, etc.
That no dwelling shall be occupied until the whole of the roads and footpaths shown on the layout plan accompanying the application, and all surface water drainage works, have been laid out and constructed in accordance with the Oxfordshire County Council Design Guide for Residential Roads and the specification for the construction of works for housing development.
Reason: In the interests of highway safety and convenience.
That the footway on the Watlington Road frontage shall be extended to the eastern boundary of the site before first occupation of any dwelling in accordance with details submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure safe access between the site and the existing footpath.
