Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings. That no development (other than the construction of the cycleway required by Condition 5 below) shall be undertaken within the 5m - 10m undeveloped strip shown on the approved site plan along the Moor Ditch. This buffer zone shall be landscaped and maintained to encourage wildlife migration along the water course in accordance with details which shall include long term design objectives, management responsibilities and maintenance schedules and shall be submitted in accordance with condition 3 above. Reason: To accord with wildlife policies of the Council. That, prior to the first occupation of any unit hereby permitted, the cycleway shown on the approved plans shall be constructed in its entirety and surfaced in accordance with a scheme to be agreed in writing with the Local Planning Authority prior to the commencement of the development, and shall thereafter be kept permanently available for use by the public. The scheme shall include 2m x 2m vision splays at the access to Unit 2. Reason: To secure the proper planning of the locality. That the pond to be filled in shall be filled in at a time to be agreed with the Local Planning Authority prior to the commencement of the development, to minimise the impact on the local wildlife. Reason: In the interests of nature conservation. That, prior to the commencement of any other development to which this permission relates a scheme for the protection of the 5m strip referred to in Condition 4 above shall be submitted to, be approved in writing by the Local Planning Authority and implemented. Reason: In the interests of nature conesrvation and to prevent pollution of the watercourse. That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: In the interests of public health. That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience. That prior to the commencement of any other development to which this permission relates the means of access between the land and the highway shall be formed, laid out and constructed with vision splays of 4.5m x 70m. Reason: In the interests of highway safety and convenience. That no unit shall be occupied until space has been laid out within the site for car parking, for the loading and unloading of goods and service vehicles and for vehicles to turn so that they may enter and leave the site in forward gear, in accordance with drawing S9/69 02 Rev P accompanying the application and such areas shall not thereafter be used for any purpose other than that for which they are provided. Reason: To comply with the Local Planning Authority's vehicle parking standards to protect local amenities. That, the area in the centre of the site shown as a parking area shall be landscaped in accordance with details approved under Condition 3. If subsequently requested in writing by the Local Planning Authority, upto 47 additional parking spaces shall be provided within 3 months of such a request being made. Reason: To safeguard the visual amenities of the area whilst meeting the genuine need for car parking. That provision of cycle racks shall be made, prior to the occupation of any unit, in accordance with a scheme to be agreed in writing with the Local Planning Authority. Reason: To ensure adequate provision is made for cyclists. That other than the offices shown on the approved plans, the buildings shall be used for purposes falling within Class B1(c) or B8 only, as defined in the Town and Country Planning (Use Classes) Order, 1987, and for no other use whatsoever. Reason: In the interest of highway safety and convenience. That the open areas outside the building shall be used for the parking of vehicles, access, manoeuvring, loading and unloading purposes only. No storage, industrial or other business use shall take place other than inside the buildings. Reason: To protect local amenities. That the whole of the roads and footpaths shown on layout plan accompanying the application, and all surface water drainage works, be laid out and constructed in accordance with a specification to be agreed with, and in all respects to the satisfaction of, the Local Planning Authority. Reason: In the interests of highway safety and convenience. That no additional floorspace to that illustrated or referred to on drawing S9/69 02P shall be created at any time except following the prior grant of a planning permission. Reason: To ensure that parking facilities remain adequate.
