Conditions / Refusal Reasons
The development hereby permitted shall be for a limited period expiring on 31 December 2001. Reason: To ensure that the landfill site on which the development is located can be restored in the time approved. The development shall be carried out solely in accordance with the details submitted with the application except as modified by conditions of this permission unless otherwise agreed by the Local Planning Authority in writing. Reason: For the avoidance of doubt and to ensure that the development is carried out in accordance with the approved plans and details. Except with the prior agreement of the Local Planning Authority in writing, no operations authorised or required by this permission shall be carried out and plant shall not be operated, other than during the following hours: Between 0700 and 1800 hours Mondays to Fridays; 0700 hours to 1300 hours on Saturdays. No such operations shall take place on Sundays or recognised public holidays unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of the amenities of the area. All plant and machinery associated with the Waste Recycling Facility shall be dismantled and removed by 31 December 2001. Reason: To ensure the proper restoration of the site. The development hereby approved shall only be carried out in accordance with a scheme or schemes which shall be submitted to the Local Planning Authority within 3 months of the date of the permission and approved in writing by the Local Planning Authority and which shall include provision for: a) The means of access to the highway, including the layout, construction and sightlines; b) The siting, design and appearance of all buildings, plant and machinery including details of the colour and texture of external materials to be used; c) The provision to be made for parking of vehicles; d) The provision to be made for the storage of wastes and recycled material; e) The measures to be taken to protect adjacent areas from excessive dust; f) The system for warning of vehicles reversing; g) The construction of a surface water drainage system; and h) The details of construction of the waste reception area. Reason: To ensure a satisfactory development. The development hereby permitted shall not take place until the scheme or schemes required by condition 5 have been approved. Reason: In the interests of highway safety and visual amenity and to protect the amenities of nearby properties. The wheels and chassis of every heavy goods vehicle visiting the site shall be adequately cleaned so that no dust or mud, slurry or other debris is deposited on the highway. Effective means shall be installed, maintained and employed for cleaning the wheels and chassis of every heavy goods vehicle leaving the site. Reason: In the interests of highway safety and to prevent mud and dust getting on the highway. No floodlighting shall be erected on site without the prior approval in writing of the Local Planning Authority. Reason: In the interests of the amenities of the occupiers of nearby properties. No skips shall be stored on the site except in specific locations agreed by the Local Planning Authority in writing. Any skips stored on the site shall be incidental to the sorting and recycling operation. Reason: In the interests of the visual amenity of the area. No special waste; as defined by Statutory Instrument 1709/1980: Control of Pollution (Special Waste) Regulations (or any other regulations amending, revoking or re-enacting those regulations), shall be passed through the Waste Recycling Facility. Reason: Deposit of special waste without an Environmental Impact Assessment would contravene the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999. No topsoils or subsoils shall be removed from the site until the operator has shown that sufficient soils for restoration works for the site in relation to permission P86/W0555/87/CM havebeen produced by the waste recycling facility and utilised in restoring that site. Reason: To ensure the retention of soils on the site for restoration purposes. No concrete crushers shall be used on site until the Local Planning Authority has agreed in writng their intended schedule of operation for the duration of the permission. Reason: To safeguard the amenity of the area and of local residents. No construction or excavation shall take place within 310 cms of the oil pipeline crossing the site except in accordance with details approved by the Local Planning Authority. Reason: To safeguard the oil pipeline.
