Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of all materials to be used in the external construction and
finishes of the development hereby permitted shall be submitted to and
approved in writing by the Local Planning Authority before the
development is commenced.
Reason: To safeguard the character of the area.
That development shall not begin until a detailed specification of the
type, design and external finish of all windows and external doors has
been submitted to and approved in writing by the Local Planning
Authority.
Reason: To ensure that the details of the development are satisfactory.
That notwithstanding the provisions of the Town and Country Planning
(General Permitted Development) Order 1995 (or any order revoking
and re-enacting that Order) no windows shall be constructed in any
elevation of the building.
Reason: To ensure that the development is not unneighbourly.
That prior to the first occupation of the building, the petrol
sign shall be removed.
Reason: To secure the proper planning of the locality.
That, prior to the first occupation of the building, the forecourt
shall be landscaped and the front boundary defined in accordance
with a scheme to be agreed. The scheme shall generally be in
accordance with the scheme shown on drawing 551-1A. In the event
of any of the trees or shrubs so planted dying or being seriously
damaged or destroyed within 3 years of the completion of the
development, a new tree or shrub or equivalent number of trees
or shrubs, as the case may be, of a species first approved by
by the Local Planning Authority, be planted and properly maintained
in a position or positions first approved by the Local Planning
Authority.
Reason: To help to assimilate the development into its surroundings.
That a site investigation to establish if there is any soil
contamination shall be undertaken prior to first occupation in
accordance with a scheme to be agreed in writing by the Local
Planning Authority and any remedial measures required undertaken.
Reason: In the interests of public health.
That the parking provision shall be as shown on the deposited drawing,
reference 551-3B all constructed, surfaced and laid out, retained
and maintained to the satisfaction of the Local Planning Authority.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities.
