Conditions / Refusal Reasons
That having regard to its relationship to the Grandstand building
which is listed as being of architectural or historic interest, and
to its prominent riverside location within the Henley-on-Thames
Conservation Area, the canopy, having a strongly linear form introduces
an unacceptable and intrusive form of development detrimental to the
visual amenities of this stretch of riverside, the riverside character
of the Henley-on-Thames Conservation Area and the setting of the
Listed Building at Phyllis Court. As such the development is contrary
to the General, Countryside and Conservation policies of the Council's
adopted South Oxfordshire Local Plan particularly policies G1, G8,
CON7, CON8, CON10, C1 and C4.
That by letter dated 22 April 1999 an Inspector appointed by the
Secretary of State for Environment, Transport and Regions dismissed
an appeal against the Council's decision to refuse planning permission
for the retention of an awning covered walkway along part of the
river front at Phyllis Court Club making particular reference in
paragraph 11 that retention of the awning throughout the year "... would
not preserve the uncluttered riverside setting of the listed building".
In the Council's view circumstances have not materially altered to
justify a different conclusion.
