Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To safeguard the character of the area. That the existing access, as shown on drawing 97/53/05 accompanying the application, shall be retained to serve Cross Leys and the dwellinghouse hereby permitted, and no other means of access shall be formed or used between the land and the highway. Reason: In the interests of highway safety and convenience and to protect local amenities. That except insofar as may be otherwise agreed in writing by the Local Planning Authority, all trees, shrubs and hedges on the land shall be retained and protected during the course of the development and for a period of five years following the completion of the development. Any trees, shrubs or plants which within that period die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To safeguard the character of the area. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help assimilate the development into its surroundings. That the garage accommodation shall be retained as such and shall not be adapted for living purposes unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: In the interests of protecting the character of the Chilterns Area of Outstanding Natural Beauty and local amenities.
