Conditions / Refusal Reasons
That the proposal would be contrary to policy G7 of the adopted South
Oxfordshire Local Plan. The proposal to use the property as a cafe
and tea room open from 7 am until 10 pm and providing hot food and
musical entertainment would be likely to result in unacceptable noise
and disturbance to nearby residents, thus detracting from their
standard of residential amenity.
That the proposal would be contrary to policies G10 and G11 of the
adopted South Oxfordshire Local Plan. Having regard to the restricted
parking facilities at and adjacent to the site, the proposal would
be likely to result in on-street parking on the narrow roads near the
site, close to a busy junction and would be harmful to the safety and
convenience of the road users and the free flow of traffic.
That the proposal represents the introduction of a use which would harm
the character and appearance of the Wheatley Conservation Area and
would thereby be contrary to policy CON15 of the adopted South Oxfordshire
Local Plan.
That in dismissing an appeal against the refusal of planning permission
for the change of use of these premises from a shop to a hot food
takeaway (ref P92/N0446) the Inspector concluded that the proposed
use would be unacceptable in highway terms, intrusive and unneighbourly
to local residents and an inappropriate form of development in a
Conservation Area. It is considered that the same considerations
apply to this proposal.
