Conditions / Refusal Reasons
That the proposal to use the property for the sale of hot food is
considered to be an inappropriate form of development adjacent to
residential properties in that it would have a detrimental effect on
the amenities of the occupants of the adjacent properties by reason
of increased noise and disturbance from additional vehicular and
pedestrian traffic generated particularly during the late evening
hours. The proposal would thereby be contrary to policy G7 in the
adopted South Oxfordshire Local Plan.
In view of the limited and restricted parking facilities adjacent to the
site, the proposal would result in on-street parking on the narrow roads
near the site close to a busy junction, which would be harmful to the
safety and convenience of the road users and the free flow of traffic.
The proposal would thereby be contrary to policies G10 and G11 of the
adopted South Oxfordshire Local Plan.
That inadequate information accompanies the application to demonstrate
that the property can be ventilated satisfactorily to avoid problems
of food odour.
That the proposal represents the introduction/intensification of a use
which would conflict with the character of the Wheatley Conservation
Area and would thereby be contrary to policy CON15 in the adopted
South Oxfordshire Local Plan.
That in an appeal against the refusal of planning permission (reference
P92/N0446) for a change of use from a shop to the sale of hot food
at 51-53 High Street, Wheatley, the Inspector, in dismissing the
appeal, considered the proposal to be unsatisfactory in highway
terms, to be an intrusive and unneighbourly form of development,
and an inappropriate intensification of use in a Conservation Area. In
the opinion of the Local Planning Authority, the same considerations
apply to this proposal.
