Description
Demolition of Sandhills School and the construction of a new school, community facilities, playing fields, public open space and new access to Merewood Avenue, including the alterations to the existing highway at the junction of Merewood Avenue and the A40 London Road.
Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the
particulars of the development contained in the application to seek
permission for the development and the plans accompanying such application
and with any approval which may be given in respect of the reserved matters
and with any conditions which may be imposed in respect of such approval.
Reason: To ensure the details of the development are carried out in
accordance with the application or any subsequent approval.
That in the case of any reserved matters, application for approval must be
made not later than the expiration of three years beginning with the date
hereof.
Reason: By virtue of the provision of Section 92 (2) (a) of the Town and
Country Planning Act, 1990.
That the development to which this approval relates must be begun not later
than whichever is the later of the following dates:
a) the expiration of five years from the date of the grant of outline
approval, or
b) the expiration of two years from the final approval of the reserved
matters, or, in the case of approval on different dates, the final
approval of the last such matter to be approved.
Reason: By virtue of the provisions of Section 92 (2) (b) of the Town and
Country Planning Act, 1990.
That the design, external appearance and landscaping (hereafter referred to
as "the reserved matters"), be reserved for subsequent approval by the
Chief Planning Officer.
Reason: The application is outline only and not accompanied by detailed
plans.
That a scheme for the landscaping of the site, including the planting of
live trees and shrubs, shall be submitted to and approved in writing by
the Chief Planning Officer prior to the commencement of the development
hereby permitted. The approved scheme shall be implemented in the first
planting season following the first use of the approved development and
thereafter be maintained to the complete satisfaction of the Chief Planning
Officer. In the event of any of the trees or shrubs so planted dying or
being seriously damaged or destroyed within 5 years of the completion of
the development, a new tree or shrub or equivalent number of shrubs, as the
case may be, of a species first approved by the Chief Planning Officer, be
planted and properly maintained in a position or positions first approved
by the Chief Planning Officer.
Reason: In the interests of the visual amenities of the area and to ensure
the creation of a pleasant environment for the development.
That except insofar as may be otherwise agreed in writing by the Chief
Planning Officer, all trees and shrubs on the land be preserved and
properly maintained and that in the event of any of the trees or shrubs
dying or being seriously damaged or destroyed within a period of five years
from the completion of the development a new tree or shrub or equivalent
number of trees or shrubs as the case may be of a similar species and size
shall be planted and properly maintained for a period of five years from
the date of planting.
Reason: To ensure the protection of trees on the land and to preserve the
amenities of the locality.
That no development shall take place until the trees on the site which are
to be retained and which are adjacent to or within the development area,
have been protected during building operations by means of a protective
fence around the edge of the canopy of trees in accordance with B.S.
5837:1991, and with the written requirements (copy attached) of the Chief
Planning Officer relating to the protection of trees. Furthermore, no
works or storing of plant or materials shall be carried out within the
fenced area.
Reason: To ensure the protection of trees on the land and to preserve the
amenities of the locality.
That no services shall be routed under the canopies of any of the trees to
be retained on the site without prior approval of the Chief Planning
Officer.
Reason: To ensure the protection of trees on the land and to preserve the
amenities of the locality.
That the building shall not be occupied until a means of vehicular access
has been constructed strictly in with the specification of the means of
access to be provided by the County Highways Engineer and that all
ancillary works be undertaken in accordance with the specification.
Reason: In the interests of highway safety.
That the school shall not be occupied until all existing means of vehicular
access to the site have been stopped up and removed in accordance with a
scheme to be submitted and approved by the Chief Planning Officer before
commencement of the development.
Reason: In the interests of highway safety.
That the school shall not be occupied until its car park has been completed
in accordance with a detailed scheme to be approved by the Chief Planning
Officer before commencement of the development.
Reason: To ensure that adequate car parking provision is made.
That details of the boundary treatment to all the school and community open
space boundaries shall be submitted to and approved by the Chief Planning
Officer before commencement of development. If any approved scheme for the
boundary treatment involves planting, then the planting shall be
implemented in the first planting season after the first use of the
approved development and thereafter be maintained to the complete
satisfaction of the Chief Planning Officer. Other approved boundary
treatments shall be completed before occupation of the school.
Reason: In the interests of the amenities of the neighbouring residents and
to enable the development to blend with its surroundings.
That no soakaways shall be constructed such that they penetrate the water
table.
Reason: To prevent pollution of ground water.
Surface water from car parking areas should be passed through a suitable
type of oil/grit separator.
Reason: To prevent pollution of the water environment.
That the surface water from the access road/car park areas be discharged
via deep trapped gullies having a minimum water seal of 85mm or similar.
Reason: To avoid pollution.
That the external walls and roofs of the buildings/dwellings be constructed
and finished in accordance with a Schedule of Materials and Finishes which
shall first have been submitted to and approved in writing by the Chief
Planning Officer.
Reason: To ensure the Materials and Finishes are compatible with the
surrounding development.
That samples of the exterior materials proposed to be used shall be
submitted to and approved in writing by the Chief Planning Officer prior to
the start of work on the site.
Reason: To ensure the materials are compatible with the surrounding
development.
That a sample panel of the external wall finish, not less than 1 metre
square, shall be provided on the application site, and approved by the
Chief Planning Officer before work to any external walls commences.
Reason: To ensure the finishes are compatible with the surrounding
development.
That the colour of the tarmac hard play area shall be submitted to and
approved by the Chief Planning Officer before commencement of the
development.
Reason: In the interests of visual amenity.
Details of all highway works included in the approved application including
a scheme for parking restraints in the area of the junction of the school
access road with Merewood Avenue and the A40 shall be submitted to and
approved by the Chief Planning Officer before development commences and
shall be completed prior to occupation of the school.
Reason: In the interests of highway safety.
That no development shall commence until a scheme to secure the provision,
management and future maintenance of the community open space indicated on
plan numbers 9708/031/A and 9708/032/A accompanying the application has
been approved by the Chief Planning Officer. The approved scheme shall be
implemented to the satisfaction of the Chief Planning Officer.
Reason: To ensure the provision of suitable, managed, public open space.
That no development shall commence until a satisfactory means of access to
the A40 has been constructed to the satisfaction of the Chief Planning
Officer in consultation with the Highways Agency.
Reason: In the interests of Highway safety.
That cycle parking for use by the school shall be provided in accordance
with the Highway Authority's parking standards before occupation of the
school.
Reason: To ensure that adequate cycle parking provision is made.
That a detailed scheme for a covered meeting area for youths, in the
community open space, shall be submitted to and approved by the Chief
Planning Officer before commencement of development, and that such a scheme
shall be completed before occupation of the school.
Reason: To ensure suitable amenity provision is made for young people in
the area.
