Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory. That prior to the commencement of any works on the site, including any demolition, temporary protective fencing shall be erected around the Sycamore tree protected by a Tree Preservation Order. The fencing shall comply with the specifications in BS.5837 and shall be erected at the perimeter of the branch spread and shall be maintained for the duration of the works. Reason: To prevent damage to the branches and root system of the Sycamore tree. That notwithstanding the details accompanying the application revised details of the boundary enclosures to plot 1 and 11 shall be submitted to the Local Planning Authority and approved in writing prior to the commencement of development. The revisions shall include the provision of a wall as shown on the plans accompanying the application but allowing for a fence beneath the canopy of the Sycamore tree and the return up to the garage block. Reason: To minimise damage to the root system of the tree. That the driveway to plot 11 shall be constructed using the no-dig method. Reason: To minimise damage to the root system of the tree. That the existing buildings on the site shall be demolished and the hardstandings broken up and all materials therefrom removed from the land prior to the occupation of any dwelling. Reason: To safeguard the character of the area and the amenities of occupiers of the new and existing dwellings. That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking and re-enacting that Order), no additional windows shall be constructed in: the north-eastern elevation of the dwelling on plot 5; the north-eastern elevation of the dwelling on plot 6; the north-western elevation of the dwelling on plot 7; the south-eastern elevation of the dwelling on plot 10; and the eastern elevation of the dwelling on plot 13 (these are the principal elevations facing existing development) other than those expressly authorised by this permision. Reason: To ensure that the development is not unneighbourly. That notwithstanding the provsions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order) no additional accesses or hardstandings shall be constructed or provided onto St. Helen's Avenue or Church Road unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To protect local amenities. That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order) the garage accommodation shall be retained as such and shall not be adapted for living purposes without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities. That a landscaping scheme to include: tree and shrub planting (including replacement hedges on road frontage); details of all site and curtilage boundaries; details of ground surface treatments; and measures to protect trees and shrubs which are to be retained, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter maintained in accordance with the approved scheme. In the event of any of the trees and shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of development a new tree or shrub or equivalent trees or shrubs, as the case may be, be planted and properly maintained. Reason: To help to assimilate the development into its surroundings. That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: In the interests of public health. That the whole of the roads and footpaths shown on the layout plan accompanying the application, and all surface water drainage works, be laid out and constructed in accordance with the Oxfordshire County Council Design Guide for Residential Roads and the specification for the construction of works for housing development, and in all respects to the satisfaction of the Local Planning Authority. Reason: In the interests of highway safety and convenience. That work be not commenced on the erection of any dwellings until the carriageways only serving the whole of that portion of the development under construction, have been laid out and constructed to the above mentioned specification, save for wearing course and kerbing. Reason: In the interests of highway safety, to provide protection of the subgrade and to ensure adequate clear running surfaces which will protect adjoining public highways from droppings of spoil, mud, etc. That before any of the development hereby permitted is occupied, the parking and turning spaces shown on the approved plan shall be constructed and such spaces shall thereafter be kept permanently available for the use of residents and visitors to the site. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities. That prior to the occupation of any dwelling the existing accesses from the site onto St Helen's Avenue and Church Road shall be permanently closed in accordance with a scheme which shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interest of highway safety and convenience. That prior to the construction of any new building a staged programme of archaeological work shall be carried out in accordance with details and by a professionally competent organisation which have been submitted to and approved in writing by the Local Planning Authority. Reason: That the development may affect sites of archaeological interest. That the existing hedge on the south eastern boundary of the site (adjacent to 5 St Helen's Avenue) shall be protected whilst development operations are in progress in accordance with the Council's Landscape Guidance leaflet attached. Reason: To safeguard the character of the area.
