Conditions / Refusal Reasons
The development would be contrary to policies of the adopted South
Oxfordshire Local Plan which seek to protect settlements from adverse
developments (Policy G1) and state that new dwellings on unallocated
sites within villages will only be permitted where an important
space is not lost, or the character of an area is not adversely
affected, where the design, height and scale is appropriate and
where there are no overriding amenity objections (Policy H4). In this
case, the development would result in the loss of important open
and undeveloped spaces which would detract from the character and
visual amenity of the locality.
The development would result in an inappropriate sub-division of
the curtilage of Brookside (a Grade 2 listed building) which would
seriously detract from the character, appearance and setting of
the listed building contrary to Policy CON7 of the adopted South
Oxfordshire Local Plan.
That, having regard to the elevated position, and bulk, scale and
massing of the dwelling on Plot 1 to its inappropriate details of
design, and the requirement to break the frontage for access, the
development would detract from the setting of Brookside, contrary
to Policy CON7 of the adopted South Oxfordshire Local Plan.
That, having regard to its size, height, bulk and massing, and to
its location relative to existing surrounding development, the
erection of the dwelling on Plot 2 would represent an oppressive
and unneighbourly form of development which would detract from the
residential amenity of occupiers of adjoining dwellings, contrary
to Policy H4 of the adopted South Oxfordshire Local Plan.
That although the trees, which are the subject of Tree Preservation
Orders, would not necessarily be damaged by construction works,
they would have such an overbearing and overshadowing effect on
the curtilages of the new dwellings, particularly in summer, that the
District Council would inevitably come under pressure to permit their
removal. The loss of the trees, which are prominent and attractive
specimens would be harmful to the character and appearance of the
area and to the setting of Brookside, contrary to Policies C16 and
CON7 of the adopted South Oxfordshire Local Plan.
