Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the materials for the hard surface shall match those on the
existing courts in colour, type and texture.
Reason: To ensure that the details of the development are satisfactory.
That details of the finish to the wall shall be submitted to and
approved in writing prior to the commencement of development.
Reason: To ensure that the details of the development are satisfactory.
That the final siting of the pavilion shall be approved by the Local
Planning Authority on site during the relocation works.
Reason: To protect the lime tree.
That a scheme for the replacement of trees on the site shall be
submitted to and approved in writing by the Local Planning Authority.
The scheme shall be implemented within 12 months of the commencement
of the approved development and thereafter maintained. In the event
of any of the trees so planted dying or being seriously damaged or
destroyed within 3 years of the completion of development, a new tree
shall be planted and properly maintained.
Reason: To help to assimilate the development into its surroundings.
That except as may otherwise be agreed in writing by the Local Planning
Authority the floodlighting shall only be used between the hours of
8.00am and 9.30pm on any day and at no other time whatsoever.
Reason: To safeguard the amenities of the occupants of adjoining
residential properties.
That prior to the first use of the wall, the fencing enclosing the
existing courts shall be extended around the wall and short court as
shown on drawing no 9162-G-3B and shall thereafter be retained as
such.
Reason: As an alternative and uncontrolled use of the wall is likely
to create a noise nuisance for nearby residents.
