Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in the application to seek permission for the development and the plan numbers 90375/930/100 104A, 90375/930/100 105, 90375/930/100 200. 90375/930/100 203 accompanying such application except as modified by conditions of this permission unless otherwise agreed by the Chief Planning Officer in writing. Reason: To ensure the details of the development are carried out in accordance with the application as approved. That development must be begun not later than the expiration of five years beginning with the date hereof. Reason: By virtue of the provisions of Section 91(1)(a) of the Town and Country Planning Act, 1990. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Chief Planning Officer prior to the commencement of the development hereby permitted. The approved scheme shall be implemented within 12 months of the first use of the approved development and thereafter be maintained to the complete satisfaction of the Chief Planning Officer. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within three years of the completion of the development, a new tree or shrub or equivalent number of shrubs, as the case may be, of a species first approved by the Chief Planning Officer, be planted and properly maintained in a position or positions first approved by the Chief Planning Officer. Reason: In the interests of the visual amenities of the area and to ensure the creation of a pleasant environment for the development. That the trees on the site which are to be retained and which are adjacent to or within the development area, shall be protected during building operations by means of a protective fence around the edge of the canopy of the trees. Furthermore, no works or storing of plant or materials shall be carried out within the fenced area. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality.
