Conditions / Refusal Reasons
That having regard to its close proximity to existing flats in Royal
Mansions, particularly flats 1, 1A, 3 and 5, the proposal would result
in an unneighbourly form of development which would be overbearing
and oppressive and would detract from the residential amenities
currently enjoyed by the occupiers of those flats. Furthermore in
dismissing the appeal (ref: APP/Q3115/A/97/281306) against the
Council's failure to determine the application for the formation of
a two bed flat at first floor level within the statutory period
(ref: P96/S0699), the Inspector stated, inter alia:-
"15. My conclusions on the main issues are that whilst the scheme
would not harm the character and appearance of the area as a
whole and not materially affect the outlook or amenities of most
local residents, it would be overbearing, intrusive and
oppressive to the occupiers of the flat to the north and detract
unacceptably from the privacy and amenity of the occupant
of flat 1A ........."
In the opinion of the Local Planning Authority the same considerations
apply to the current application and the development would be contrary
to the provisions of the Council's adopted South Oxfordshire Local
Plan particularly policy H4.
