Conditions / Refusal Reasons
That, having regard to the extent of the external alterations and the
associated disruption to the historic structure, the proposed works
would seriously detract from the character and appearance of
20 Market Place as a Grade II listed building and would fail to
preserve or enhance the character and appearance of the Henley-on-Thames
Conservation Area. As such, the development would be contrary to the
advice in PPG15 and the provisions of the Council's adopted South
Oxfordshire Local Plan, particularly policies CON6, CON8 and CON10.
That policy S3 of the Council's adopted South Oxfordshire Local Plan
states that within the primary shopping frontages in Henley-on-Thames
the change of use of a shop (Class A1) to a non-shop use will not be
permitted if it would undermine the vitality and viability, and the
dominant retailing character and function of, the Primary Shopping
Frontage. In Henley-on-Thames as a whole, and in this street frontage,
the penetration of non-shop uses into all the primary shopping frontages
defined on the Local Plan's Henley Inset Proposals Map has reached
a level where the dominant retailing character and function would be
undermined with the loss of the shop unit fronting Market Place to
Class A3 use contrary to policy S3. The unit occupies an important
position in Market Place where the existence of the shop use would serve
to draw pedestrian shoppers to Market Place through the proposed arcade
to Kings Road car park.
That the proposal would be contrary to Policy S5(V) of the Council's
adopted South Oxfordshire Local Plan in that it would prevent the
provision of a pedestrian shopping arcade linking Market Place to the
Kings Road carpark. The Henley Town Centre Strategy sees the provision
of this arcade as being important in enhancing the retail function
of the Henley-on-Thames town centre.
That the proposal would be contrary to policies E6, H9 and H10 of the
Council's adopted South Oxfordshire Local Plan in that it would result
in the loss of first floor residential accommodation. As such, the
proposal would be detrimental to the character and vitality of the
Henley-on-Thames town centre by reducing the variety of uses and the
stock of smaller residential units.
