Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the external walls, roof and canopy to be constructed and finished
in accordance with a schedule of materials and finishes which shall first
have been submitted to and approved in writing by the Local Planning
Authority before the development commences. Thereafter, the materials and
finishes used shall be in accordance with the approved schedule.
Reason: To ensure that the details of the development are satisfactory.
That, with the exception of any planting specifically shown to be removed,
or as may otherwise be agreed in writing by the Local Planning Authority,
all trees, shrubs and hedges on the land shall be retained and protected
during the course of the development and for a period of five years
following the completion of the development. Any trees, shrubs or plants
which within that period die, are removed or become seriously damaged or
diseased, shall be replaced in the next planting season with others of a
similar size and species, unless the Local Planning Authority gives
written consent to any variation.
Reason: To safeguard the character of the area.
That the pathway shown on drawing no. 1216-04 B shall be constructed in
accordance with a scheme, which shall include details of construction,
that shall first have been submitted to and approved in writing by the
Local Planning Authority. Where it is necessary to excavate within the
canopy of the nearby trees, located to the rear of 95 and 97 Wayside
Green, there shall only be hand digging and any root pruning shall be
carried out by a qualified tree surgeon in accordance with BS3998.
Reason: In order to safeguard the nearby trees.
