Description
Erection of five dwellings and garages and formation of access - variation to permission P94/N0226. (As amended by Dwg Nos. 2A, 4A, 5A and 6 accompanying Agents letter dated 14 August 1998 and by Dwg Nos.1B and 3B deposited 3 September 1998 and Dwg No.1D accompanying Agents letter dated 12 October 1998 and by Drg Nos 1F, 3D and 4C accompanying Agents letter dated 13 November 1998 and as amended by Drg Nos. 3F and 13C accompanying Agents letter dated 4 January 1999).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of the materials to be used for the external walls and roofs
shall be submitted to and approved in writing by the Local Planning
Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory.
That prior to the commencement of any other development to which this
permission relates the means of access between the land and the highway
shall be formed, laid out and constructed with 4.5 metres by 90 metres
vision splays.
Reason: In the interests of highway safety and convenience.
That no dwelling shall be occupied until the whole of the roads and
footpaths shown on the layout plan accompanying the application, and all
surface water drainage works, have been laid out and constructed in
accordance with the Oxfordshire County Council Design Guide for
Residential Roads and the specification for the construction of works for
housing development.
Reason: In the interests of highway safety and convenience.
That work be not commenced on the erection of any dwellings until
the carriageways only serving the whole of that portion of the
development under construction, have been laid out and constructed
to the above mentioned specification, save for wearing course and
kerbing.
Reason: In the interests of highway safety, to provide protection
of the subgrade and ensure adequate clear running surfaces
which will protect adjoining public highways from droppings
of soil, mud, etc.
That no dwelling shall be occupied until space has been laid out within
its curtilage for four cars to be parked, and such spaces shall be
retained and maintained.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities.
That surface water shall not be disposed of other than in accordance
with a detailed surface water drainage scheme which shall first have
been submitted to and approved in writing by the Local Planning
Authority.
Reason: In the interests of public health.
That prior to the implementation of the development, all industrial,
storage and agricultural activities on the site, whether authorised
or unauthorised, shall cease, and all buildings, materials and
vehicles in connection with those uses shall be removed from the land.
Reason: To ensure that the details of the development are satisfactory.
That except for the formation of the new access to Oxford Road, the
existing hedge along the frontage (southern boundary) of the site
shall be retained at a height of not less than 3 metres, in all
respects to the satisfaction of the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings.
That a scheme for the landscaping of the site, including the planting
of live trees and shrubs, the treatment of forecourts and driveways
and the provision of boundary fencing and screen walling shall be
submitted to and approved in writing by the Local Planning Authority
prior to the commencement of the development hereby permitted. The
scheme shall be implemented as approved during the first planting
season following commencement of the occupation of the buildings and
thereafter be maintained in accordance with the approved scheme
to the complete satisfaction of the Local Planning Authority. In
the event of any of the trees or shrubs so planted dying or being
seriously damaged or destroyed within 3 years of the completion
of the development, a new tree or shrub or equivalent number of
trees or shrubs, as the case may be, of a species first approved by
the Local Planning Authority, be planted and properly maintained
in a position or positions first approved by the Local Planning
Authority.
Reason: To help to assimilate the development into its surroundings.
That except insofar as may be otherwise agreed by the Local Planning
Authority, all trees and hedges on the land shall be preserved and
properly maintained.
Reason: To safeguard trees and hedges which are visually important.
