Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of the materials to be used for the external walls and roof
shall be submitted to and approved in writing by the Local Planning
Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory.
That notwithstanding the details submitted with the application, a scheme
for the landscaping of the site, including the planting of live trees and
shrubs and the provision of boundary fencing, shall be submitted to and
approved in writing by the Local Planning Authority prior to the commence-
ment of the development hereby permitted. The scheme shall be implemented
as approved within 12 months of the commencement of the approved develop-
ment and thereafter be maintained in accordance with the approved scheme
to the complete satisfaction of the Local Planning Authority. In the
event of any of the trees or shrubs so planted dying or being seriously
damaged or destroyed within 3 years of the completion of the development,
a new tree or shrub or equivalent number of trees or shrubs, as the case
may be, of a species first approved by the Local Planning Authority, be
planted within the following planting season and properly maintained in
a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings.
That prior to the commencement of the development details of all noise
levels arising from existing and proposed operating equipment on the
site shall be submitted to the Local Planning Authority in writing and
such noise attenuation measures as may be required by the Council shall
be implemented prior to the commencement of the development.
Reason: To protect local amenities.
That notwithstanding the provisions of Article 3, Part 24 of Schedule 2
to the Town and Country Planning (General Permitted Development) Order
1995 (or any order revoking or re-enacting that Order) no equipment shall
be erected/attached to the mast hereby permitted, other than that shown
on the plans accompanying the planning application, without the prior
grant of planning permission from the Local Planning Authority.
Reason: In order that the effect of the development upon the amenity of
the area can be assessed.
That any apparatus, building or structure shall be removed from the
land, building or structure on which it is situated, within three months
after it is no longer required for telecommunication purposes, and such
land, building or structure shall be restored to its condition before
the development took place.
Reason: To protect the visual amenity of the area and the open nature of
the Oxford Green Belt.
