Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory. That a scheme for the landscaping of the site including the planting of live trees and shrubs, the treatment of the access road and hardstandings, gate details and the provision of hedging along the northern side of the drain and adjacent to the entrance gates shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings and to ensure that the details of the development are satisfactory. That except insofar as may be otherwise agreed by the Local Planning Authority, all trees, shrubs and hedge plants on the land be preserved and properly maintained during the course of building operations and for a period of three years following completion of the development and that in the event of any of the trees, shrubs or hedge plants dying or being seiously damaged or destroyed during that period, a new tree, shrub or hedge plant or equivalent number of trees, shrubs or hedge plants as the case may be of a species first approved by the Local Planning Authority be planted and properly maintained in a position or positions first approved by the Local Planning Authority, such planting to be implemented as approved within 12 months of the loss of the previously existing planting. Reason: To safeguard trees, shrubs and hedge plants which are of amenity importance. That the units shall not be occupied or used until the means of access between the land and the highway has been improved, laid out and constructed in accordance with the specification of the means of access attached hereto and all ancillary works therein specified have been undertaken strictly in accordance with the said specification. Reason: In the interests of public health. That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: In the interests of public health. That those buildings to be demolished shall be demolished and the materials removed from the land, except for those used as hardcore forming the base of the hardstanding areas, within three months of the first occupation and use of the buildings hereby permitted. Reason: To ensure satisfactory comprehensive development. That the land located to the south of the drain shown on the submitted plan shall not at anytime be used for any industrial purpose, including storage of plant and machinery and parking of vehicles, without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof. Reason: To secure the proper planning of the locality and to safeguard the character of the area. That the area between the gates and the highway as shown edged red on the attached plan reference P97/W0022/'A' shall not at any time be used for open storage or for the parking of vehicles, plant or machinery without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof. Reason: To safeguard the character of the area and to protect local amenities. That the areas on the access drive to be surfaced with paviours as shown on the plan deposited on 14 April 1997 shall be so surfaced within three months of the first occupation and use of any unit. Reason: To ensure that the details of the development are satisfactory. That the hardstandings at the eastern end of the access road as shown on the plan deposited on 14 April 1997 shall be provided and retained for the parking of staff and visitors vehicles and shall not be used for the storage of plant or machinery without the prior permission in writing of the Local Planning Authority. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities.
