Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To safeguard the character of the area. That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience. That the dwelling shall not be occupied until the means of access between the land and the highway has been formed, laid out and constructed in such position and with such vision splays as shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of highway safety and convenience. That the dwelling shall not be occupied until the existing accesses serving Easby Orchard and Quickwood have been permanently and effectively closed in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of highway safety and convenience. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help assimilate the development into its surroundings. That except insofar as may be otherwise agreed in writing by the Local Planning Authority, all trees, shrubs and hedges on the land shall be retained and protected during the course of the development and for a period of five years following the completion of the development. Any trees, shrubs or plants which within that period die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To safeguard the character of the area. That the existing trees, shrubs and hedges on the land shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development. Reason: To safeguard the character of the area. That the first floor en-suite bathroom windows in the western (side) elevation of the dwelling hereby permitted shall be glazed in obscure glass prior to first occupation of the premises and shall thereafter be retained as such. Reason: To ensure that the development is not unneighbourly. That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows shall be constructed in the western (side) elevation of the dwelling other than those expressly authorised by this permission. Reason: To ensure that the development is not unneighbourly. That, prior to the commencement of development, the slab levels of the dwelling in relation to adjoining properties and land shall be submitted to and approved in writing by the Local Planning Authority; and the dwelling shall be constructed with slab levels in accordance with an approved scheme. Reason: To ensure that the details of the development are satisfactory.
