Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That notwithstanding the provisions of the Town and Country Planning
(Use Classes) Order 1987 and the Town and Country Planning (General
Permitted Development) Order 1995, Unit 5 indicated on the approved plans
shall be used only for purposes falling within Use Classes A1, A2 or A3.
Reason: To protect the special interest and historic character of
The Old White Hart as a Grade II listed building.
That notwithstanding the provisions of the Town and Country Planning
(Use Classes) Order 1987 and the Town and Country Planning (General
Permitted Development) Order 1995, the ground and first floors of
Units 3 and 4 indicated on the approved plans shall be used only for
purposes falling within Use Class A3.
Reason: To protect the special interest and historic character of The
Old White Hart as a Grade II building and to protect the
vitality and viability of Hart Street as a primary shopping
frontage.
That notwithstanding the provisions of the Town and Country Planning
(Use Classes) Order 1987 and the Town and Country Planning (General
Permitted Development) Order 1995 ventilation and/or extraction
equipment, the details of which shall have previously been submitted
to and approved in writing by the Local Planning Authority shall be
installed prior to the first use of any of the Units for Class A3
purposes.
Reason: In the interest of the amenity of neighbouring residents.
That details of surface water drainage works shall be submitted to and
approved in writing by the Local Planning Authority prior to the
development commencing.
Reason: In the interests of public health.
