Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the external walls and roofs. Reason: To ensure that the details of the development are satisfactory. That development shall not begin until a detailed specification of the type, design and external finish of all windows, rooflights, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory. That except insofar as may be otherwise agreed in writing by the Local Planning Authority, all trees, shrubs and hedges on the land shall be retained and protected during the course of the development and for a period of five years following the completion of the development. Any trees, shrubs or plants which within that period die, are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To safeguard the character of the area. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the erection of a post and rail fence, the planting of a hedge and the reinstatement of the highway verge to close the existing means of vehicular access, and the provision of boundary fencing and screen walling, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help assimilate the development into its surroundings. That, with the exception of the main barn and the lean-tos which are to become the study and kitchen, all existing buildings and structures on the land shall be demolished prior to the occupation of the barn as a dwelling and the materials therefrom removed from the land. Reason: These buildings are considered to be utilitarian and of no particular merit. Their removal is essential in order to allow for a comprehensive development of the site. That, prior to the commencement of any other development hereby permitted, a new vehicular access, with vision splays of 2.4 metres (x distance) to each of the site's roadside boundaries (y distance), shall be formed at the southern end of the site in accordance with a scheme which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: In the interest of highway safety and convenience. That, prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway, as referred to in condition 7 hereof, shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience. That, following the construction of the means of access referred to in conditions 7 and 8 hereof and prior to the commencement of any other development hereby permitted, the existing vehicular access between the site and the highway shall be closed by the erection of a fence and the planting of a hedge to match those existing on the frontage of the site and the highway verge shall be re-instated, all in accordance with the requirements of condition 5 hereof. Reason: In the interests of highway safety and convenience. That notwithstanding the provisions of Article 3 of, Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no development within Class A of Part 1 of Schedule 2 to the Order shall be carried out on the land unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To protect local amenities. That, unless otherwise agreed in writing by the Local Planning Authority, the first floor windows in the side elevations of the building shall be inserted in accordance with the details shown on drawing no. 1628-97-5A (main frame detail elevations). Reason: To ensure that the windows are only inserted within the spaces between the main frame of the building which will ensure that the historic fabric and character of the building is retained.
