Conditions / Refusal Reasons
That this permission is granted as a renewal of the earlier conditional
outline planning permission granted on 21 March 1994 under application
reference P93/S0583/O and the development shall be carried out strictly in
accordance with the description, plans and specifications contained in
application reference P93/S0583/O and subject to the conditions hereby
imposed.
Reason: As the application seeks renewal of the earlier conditional
planning permission and is not accompanied by detailed plans and
specifications.
That approval of the details of the siting, design and external appearance
of the building(s), the means of access thereto and the landscaping of
the site (hereinafter called "the reserved matters") shall be obtained
from the Local Planning Authority in writing before any development is
commenced.
Reason: As the application is in outline only and not accompanied by
detailed plans.
That application for approval of the reserved matters shall be made to the
Local Planning Authority before the expiration of three years from the
date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the development hereby permitted shall be begun either before the
expiration of five years from the date of this permission, or before the
expiration of two years from the date of approval of the last of the
reserved matters to be approved, whichever is the later.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of all materials to be used in the external construction and
finishes of the development hereby permitted shall be submitted to and
approved in writing by the Local Planning Authority before the
development is commenced.
Reason: To safeguard the character of the area.
That no development shall take place until there has been submitted to
and approved in writing by the Local Planning Authority a scheme of
landscaping which shall include indications of all existing trees and
hedgerows on the land, and details of any to be retained, together with
measures for their protection in the course of development.
Reason: To protect local amenities.
That all planting, seeding or turfing comprised in the approved scheme
of landscaping shall be carried out in the first planting and seeding
seasons following the occupation of the buildings or the completion of
the development, whichever is the sooner; and any trees or plants which
within a period of 5 years from the completion of the development die,
are removed or become seriously damaged or diseased shall be replaced
in the next planting season with others of similar size and species,
unless the Local Planning Authority gives written consent to any
variation.
Reason: To help to assimilate the development into its surroundings.
That details of surface water drainage works shall be submitted to and
approved in writing by the Local Planning Authority prior to the
development commencing.
Reason: In the interests of public health.
That no dwelling shall be occupied until space has been laid out within
the site for cars to be parked in accordance with the Local Planning
Authority's vehicle parking standards, and for vehicles to turn so
that they may enter and leave the site in forward gear, and such areas
shall not thereafter be used for any purpose other than that for which
they are provided.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities and in the interest
of highway safety and convenience.
That the carport accommodation shall be retained as such and shall not
be adapted for living purposes unless planning permission has first
been granted by the Local Planning Authority on a formal application in
respect thereof.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities and in the interest of
highway safety and convenience.
That no other development hereby permitted shall commence until space
has been laid out within the site for 8 vehicles associated with the
Henley ATE to be parked in accordance with the Local Planning Authority's
vehicle parking standards and for such vehicles to turn so that they
may enter and leave the site in forward gear, and such areas shall not
thereafter be used for any purpose other than that for which they are
provided.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities and in the interest of
highway safety and convenience.
That, prior to the commencement of the development, a scheme for the
erection of screen walls and boundary fences shall be submitted to and
approved in writing by the Local Planning Authority. No dwelling shall
be occupied until an approved walling and fencing scheme has been
implemented and completed.
Reason: To ensure that the development is not unneighbourly.
That vehicular and pedestrian access to the Henley ATE site shall only
be gained from Greys Road.
Reason: In the interests of highway safety and convenience.
That vehicular and pedestrian access to the dwellings hereby permitted
shall only be gained from Deanfield Avenue in accordance with a scheme
which shall first have been submitted to and approved in writing by the
Local Planning Authority and no other development hereby permitted
shall commence until such access has been formed, laid out, constructed
and completed in accordance with an approved scheme.
Reason: In the interests of highway safety and convenience.
Before the development is commenced a detailed site investigation shall
be carried out to establish if the site is contaminated, to assess the
degree and nature of the contamination present, and to determine its
potential for the pollution of the water environment. The method and
extent of this investigation shall be agreed with the Planning Authority
prior to commencement of the work. Details of appropriate measures to
prevent pollution of groundwater and surface water, including
provisions for monitoring, shall then be submitted to and approved in
writing by the Planning Authority before the development commences. The
development shall then proceed in strict accordance with the measures
approved.
Reason: To prevent pollution of the water environment.
Development shall not begin until a scheme to deal with contamination of
the site has been submitted to and approved in writing by the Local
Planning Authority. The above scheme shall include an investigation
and assessment to identify the extent of contamination and the measures
to be taken to avoid risk to the water environment when the site is
developed. Development shall not commence until the measures approved
in the scheme have been implemented.
Reason: To prevent pollution of the water environment.
In non-contaminated ground no soakaways shall be constructed such that
they penetrate the water table, and they shall not in any event exceed
2 metres in depth below existing ground level.
Reason: To prevent pollution of groundwater.
