Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That this permission is granted as a renewal of the earlier conditional planning permission granted on 23 July 1992 under application reference P91/S0528, and the development shall be carried out strictly in accordance with the description, plans and specifications contained in application reference P91/S0528, as amended by drawing no. 9110.8E accompanying agents' letter dated 8 June 1992, and subject to the conditions hereby imposed. Reason: As the application seeks renewal of the earlier conditional planning permission and is not accompanied by detailed plans and specifications. That the buildings hereby permitted shall not be occupied until all existing buildings on the site have been demolished and the materials therefrom removed from the land. Reason: To accord with the policy of the Local Planning Authority and to safeguard the character of the area. That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the external walls and roofs of the buildings. The schedule shall include the use of plain clay roofing tiles. Reason: To ensure that the details of the development are satisfactory. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help assimilate the development into its surroundings. That the existing trees and hedges on the land shall be protected whilst development operations are in progress, in accordance with a scheme, which shall include the provision of protective fencing, to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development. Reason: To safeguard the character of the area. That the garage with first floor bedroom accommodation hereby permitted shall be occupied and used only in connection with and ancillary to the use of the public house with ancillary manager's living accommodation, as specified in the application, and shall not be occupied or used separately therefrom. Reason: To accord with the policy of the Local Planning Authority and to safeguard the character of the area. That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the deposited drawing no. 9110.8E and the attached specification and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification and deposited plan. Reason: In the interests of highway safety and convenience. That the buildings hereby permitted shall not be occupied until the parking provision has been constructed, surfaced and laid out as shown on drawing no. 9110.8E; and such parking provision shall be retained thereafter for the use of residents, employees and visitors to the site. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities. That the buildings hereby permitted shall not be occupied until turning and servicing provision has been constructed, surfaced and laid out within the site in accordance with a scheme which shall first have been submitted to and approved in writing by the Local Planning Authority; and such turning and servicing provision shall be retained thereafter. Reason: In the interest of highway safety and convenience. That the buildings hereby permitted shall not be occupied until works for the disposal of foul sewage have been provided on the site in accordance with details which shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: In the interests of public health and to avoid pollution. That the buildings hereby permitted shall not be occupied until works for the disposal of surface water drainage have been provided on the site in accordance with details which shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: In the interests of public health and to avoid pollution. That the finished ground floor level of the buildings hereby permitted shall not exceed 35.8 metres above Ordnance Datum (Newlyn). Reason: To assist in the prevention of flooding of adjoining land and to safeguard the character and appearance of this area of low-lying land.
