Conditions / Refusal Reasons
That having regard to the restricted width of the plot and to the size
of the proposed house, the proposal would result in a cramped form
of development and an overdevelopment of the site which would be out
of keeping with the spacious setting of existing development in this
part of Woodlands Road. The development would, therefore, detract
from the character and appearance of the area. In these circumstances,
the development would be contrary to the provisions of the Council's
adopted Rural Areas Local Plan, particularly policies G5 and H4, and
approved South Oxfordshire Local Plan (as proposed to be modified),
particularly policies G8 and H4.
That having regard to its height and bulk and to its siting in close
proximity to adjacent dwellings, the proposed house would result in
an intrusive and unneighbourly form of development which would be
oppressive and overbearing and, thereby, would be detrimental to the
residential amenities currently enjoyed by the residents of the
adjacent dwellings. Therefore, the development would be contrary to
the provisions of the Council's adopted Rural Areas Local Plan,
particularly policies G5 and H4, and approved South Oxfordshire Local
Plan (as proposed to be modified), particularly policies G8 and H4.
That in a letter dated 4 March 1980 in respect of an appeal (reference
T/APP/5355/A/79/10658) against the Council's decision on
application P79/S0178 to refuse planning permission for the erection
of a detached house on the application site, the Inspector dismissed
the appeal and stated:-
"In this setting I consider that the proposed two storey house, with
an overall width of 23ft, would not only result in cramped development
on this exceptionally narrow frontage site but also present a
congested and incongruous appearance in conjunction with the adjoining
bungalow properties which would spoil the generally spacious character
of this part of Woodlands Road ...... I am firmly of the opinion
that the flank gable end wall extending to within some 3ft of the
northern boundary towards the rear of the proposed house would
seriously overshadow part of the side garden and rear window at the
back of No 59 and the long, high southern flank wall would also
intrude to some extent in the outlook from the back of the bungalow
to the south."
and in the opinion of the Local Planning Authority, similar considerations
apply to the current proposal.
