Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of the materials to be used for the external walls shall be
submitted to and approved in writing by the Local Planning Authority
before any development commences.
Reason: To ensure that the details of the development are satisfactory.
That the roof shall be covered with plain clay tiles a sample of which
shall first have been submitted to and approved in writing by the Local
Planning Authority before the development commences.
Reason: To ensure that the details of the development are satisfactory.
That access to and from the site shall only be taken from the
existing access on the main road to the south of the site, as
confirmed by agent's letter dated 17 June 1998.
Reason: To protect the amenity of the area.
That except for those trees shown to be removed on drawing 961003-03,
and excluding the four pine trees located to the north east of the
proposed dwelling, all trees on the site shall be retained.
Reason: To safeguard important trees.
That prior to the commencement of any works, protective fencing in
accordance with BS 5837 shall be erected and approved in writing by
the District Council.
Reason: To safeguard important trees.
That notwithstanding the details submitted with the application,
the proposed garage shall be re-sited in accordance with details
which shall be first submitted to and approved in writing by the
District Council.
Reason: To safeguard important trees.
That any works undertaken to the existing driveway from the main road
shall be implemented using the 'no dig' method.
Reason: To safeguard important trees.
That notwithstanding the provisions of Article 3 of, and Classes A
and B of Part 1 of Schedule 2 to the Town and Country Planning
General Permitted Development) Order 1995 (or any order revoking or
re-enacting that Order), no development within Classes A and B of
Part 1 of Schedule 2 to the Order shall be carried out on the land
unless planning permission has first been granted by the Local
Planning Authority on a formal application in respect thereof.
Reason: To protect local amenities.
That prior to the commencement of the development, full details of
existing ground levels on the site and the damp proof course level of the
proposed dwelling shall be submitted to and approved by the Local
Planning Authority in writing.
Reason: To ensure that the details of the development are satisfactory.
