Conditions / Refusal Reasons
That the proposal would be contrary to policy EN5 of the Oxfordshire
Structure Plan, policy G4 of the Oxfordshire Structure Plan (Deposit
Draft), policy GB1 of the Council's adopted Central Oxfordshire Local
Plan, policy GB2 of the Council's approved South Oxfordshire Local
Plan (as proposed to be modified) and Government advice in PPG2.
The site lies within the Oxford Green Belt wherein there is a
general presumption against new development apart from that which
is essential for the needs of agriculture, forestry and recreation
or some other purpose appropriate to the Green Belt. The proposal
would result in the erection of a permanent dwelling which would
be detrimental to the rural open character and visual amenity of
the Green Belt. No justification has been put forward to warrant
overriding established Green Belt policies.
That the proposal would be contrary to the environmental, countryside
and housing policies of the Oxfordshire Structure Plan (G1, EN1, EN4
and H1), the Oxfordshire Structure Plan Deposit Draft (G1, G2, G5, EN1,
EN5 and H1), the adopted Central Oxfordshire Local Plan (G1, G3, C5,
H3 and H4) and the approved South Oxfordshire Local Plan (G1, G5, C3,
H5 and H6). The site does not constitute a strict infill plot and lies
within an Area of Great Landscape Value wherein the Council will seek
to conserve and enhance the quality of the landscape.
That the proposal would result in the undesirable consolidation of an
existing scatter of development which lies beyond the built up limits
of Garsington and would be detrimental to the rural character and
appearance of the locality which lies within the Oxford Green Belt
and an Area of Great Landscape Value.
That in a decision letter dated 3 August 1990 on an appeal against
the decision of the Council to refuse planning permission for the
erection of a bungalow on the site, the Inspector dismissed the appeal
and concluded that:-
"The Council's long term objective is the removal of all mobile homes
from the land and its return to agricultural use. I consider this
to be a worthwhile aim given the location of the land in an Area
of Great Landscape Value and in the Green Belt"....
"In my view the appeal project would be harmful to the aims and
provisions of the Green Belt policies by making permanent the existing
intrusion of development along Kiln Lane into the open countryside
within the relatively narrow sector of Green Belt between Garsington
and the built up area of Oxford."
The Council take the view that there has been no change in circumstances
to warrant overriding this decision.
