Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That samples of the materials to be used for the external walls and roofs
shall be submitted to and approved in writing by the Local Planning
Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory.
That a scheme for the landscaping of the site including the planting of
live trees and shrubs, the treatment of driveways and hardstandings, the
provision of boundary fencing and screen walling for dustbin storage
area and planting scheme for pergola screening shall be submitted to
and approved in writing by the Local Planning Authority prior to the
commencement of the development hereby permitted. The scheme shall be
implemented as approved within 12 months of the commencement of the
approved development and thereafter be maintained in accordance with
the approved scheme to the complete satisfaction of the Local Planning
Authority. In the event of any of the trees or shrubs so planted dying
or being seriously damaged or destroyed within 3 years of the completion
of the development, a new tree or shrub or equivalent number of trees
or shrubs, as the case may be, of a species first approved by the Local
Planning Authority, be planted and properly maintained in a position or
positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings.
That except insofar as may be otherwise agreed by the Local Planning
Authority, all trees, shrubs and hedges on the land be preserved and
properly maintained and that in the event of any of the trees dying or
being seriously damaged or destroyed, a new tree or equivalent number
of trees, as the case may be, of a species first approved by the Local
Planning Authority, be planted and properly maintained in a position
or positions first approved by the Local Planning Authority.
Reason: To safeguard trees which are visually important.
That the existing trees on the land shall be protected whilst
development operations are in progress, in accordance with a scheme
to be first agreed in writing with the Local Planning Authority and
to be implemented prior to the commencement of the development.
Reason: To safeguard trees which are visually important.
That no mechanical means shall be used for excavation work to create
the car parking area located on the southern side of the site in the
proximity of the trees on this boundary. In this area only hand held
implements shall be employed to carry out the operation.
Reason: To safeguard the root system of trees which are visually
important.
That the bedroom accommodation proposed for flats 5 and 10 shall be
constructed as shown on plan ref. 9603/524-11B and conversion to a use
other than as stated on the approved plans shall not take place unless
a planning application in respect thereof is submitted to and approved
in writing by the Local Planning Authority.
Reason: That the use of the accommodation for purposes other than
bedroom space would not comply with the Council's standards for
maintaining privacy between adjoining properties.
