Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That samples of the materials to be used for the external walls, roof and boundary walls shall be submitted to and approved by the Local Planning Authority in writing before any development commences. Reason: To ensure that the details of the development are satisfactory. That the new boundary walls shown on the approved plan shall be constructed prior to the first use of the site hereby permitted. Reason: To ensure that the details of the development are satisfactory. That a scheme for the landscaping of the site, including the planting of live trees and shrubs and the treatment of the access road and hardstandings, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings. That the proposed equipment for the car wash and jet wash shall be provided and retained in accordance with details which shall first have been submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. The scheme shall include the provision of doors for the car wash which shall remain closed during the washing cycle and measures for noise attenuation. Reason: To ensure that the development is not unneighbourly. That the car wash and jet wash shall not be used other than between the hours of 07.30 and 19.30 on any weekday and between 8.30 and 19.30 on Saturdays, Sundays and Bank Holidays. Reason: To ensure that the development is not unneighbourly. That the fascia of the canopy shall not be illuminated. Reason: To protect local amenities. That between 23.00 hrs and 07.00 hrs the following day, the site shall only be illuminated in accordance with the details set out in the agent's letter dated 8 January 1997 and accompanying plans. Reason: To protect local amenities. That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health and to avoid pollution. That surface water shall not be disposed of other than in accordance with a detailed surface water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health. Before the development is commenced a detailed site investigation shall be carried out to establish if the site is contaminated, to assess the degree and nature of the contamination present, and to determine its potential for the pollution of the water environment. The method and extent of this investigation shall be agreed with the Planning Authority prior to commencement of the work. Details of appropriate measures to prevent pollution of groundwater and surface water, including provisions for monitoring, shall then be submitted to and approved in writing by the Local Planning Authority before the development commences. The development shall then proceed in strict accordance with the measures approved. Reason: To prevent pollution of the water environment.
