Conditions / Refusal Reasons
That notwithstanding any indications as to these matters which have been
given in this application, no development shall be started until full
details of the following have been submitted to, and approved in writing
by, the Local Planning Authority:-
(a) the siting, layout and number of buildings and the means of access
thereto;
(b) the plans and elevations of all buildings;
(c) the colour and type of facing materials to be used for the external
walls;
(d) the provision to be made on the site for the garaging and parking of
motor vehicles in accordance with the Local Planning Authority's
approved standards;
(e) a scheme for the landscaping of the site including the planting of live
trees, the treatment of forecourts and driveways, and the provision of
boundary fencing and screen walling.
That application for the approval of the reserved matters referred to in
Condition 1 above shall be made to the Local Planning Authority not later
than three years from the date of this permission, and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the development hereby permitted shall be begun either before the
expiration of five years from the date of this permission, or before the
expiration of two years from the date of approval of the last of the
reserved matters to be approved, whichever is the later.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That prior to the commencement of any other development to which this
permission relates, the means of access between the land and the highway
shall be formed, laid out and constructed strictly in accordance with the
specification of the means of access attached hereto, and all ancillary
works therein specified shall be undertaken strictly in accordance with
the said specification.
Reason: In the interests of highway safety and convenience.
That work be not commenced on the erection of any dwellings until the
carriageways only serving the whole of that portion of the development
under construction, have been laid out and constructed to the above
mentioned specification, save for wearing course and kerbing.
Reason: In the interests of highway safety, to provide protection of the
subgrade and to ensure adequate clear running surfaces which will
protect adjoining public highways from droppings of spoil, mud,
etc.
That no dwelling shall be occupied until the whole of the roads and
footpaths shown on the layout plan accompanying the application, and all
surface water drainage works, have been laid out and constructed in
accordance with the Oxfordshire County Council Design Guide for
Residential Roads and the specification for the construction of works for
housing development.
Reason: In the interests of highway safety and convenience.
That parking facilities to meet the Local Authority's approved standards
shall be provided on the site and retained as such.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities.
No solid matter shall be deposited so that it passes or is likely to pass
into any watercourse.
Reason: To prevent pollution of the water environment.
No soakaways shall be constructed such that they penetrate the water
table, and shall not in any event exceed 2 metres in depth below the
existing ground level.
Reason: To prevent pollution of groundwater.

Reason: To prevent pollution of groundwater.
Before the development is commenced a detailed site investigation shall
be carried out to establish if the site is contaminated, to assess the
degree and nature of the contamination present, and to determine its
potential for the pollution of the water environment. The method and
extent of this investigation shall be agreed with the Planning Authority
prior to the commencement of the work. Details of appropriate measures
to prevent pollution of groundwater and surface water, including
provisions for monitoring, shall then be submitted to and approved in
writing by the Planning Authority before the development commences. The
development shall then proceed in strict accordance with the measures
approved.
Reason: To prevent pollution of the water environment.
That no development shall commence until all existing buildings within
the site have been demolished and the materials therefrom removed from
the land.
Reason: To safeguard the character of the area.
That measures to remove contaminated materials and soil from the site
shall be carried out prior to any development (apart from the removal
of existing buildings and the works to determine the potential for the
pollution of the water environment required in condition 11) in
accordance with a scheme based on detailed site investigations and
analysis which shall have been submitted to and approved in writing by
the Local Planning Authority.
Reason: In the interests of public health.
That details of surface water drainage works shall be submitted to and
approved in writing by the Local Planning Authority prior to the
development commencing.
