Conditions / Refusal Reasons
That notwithstanding any indications as to these matters which have been given in this application, no development shall be started until full details of the following have been submitted to, and approved in writing by, the Local Planning Authority:- the layout of the site, including roads and buildings and surface water drainage; the plans and elevations of all buildings; the colour and type of facing materials to be used for the external walls and roofs; the provision to be made on the site for the garaging and parking of motor vehicles in accordance with the Local Planning Authority's approved standards; the provision to be made for open space and children's play spaces; a scheme for the landscaping of the site including the planting of live trees, the treatment of forecourts and driveways, and the provision of boundary fencing and screen walling. Reason: As the application is in outline and not accompanied by detailed plans. That application for the approval of the reserved matters referred to in Condition 1 above shall be made to the Local Planning Authority not later than three years from the date of this permission, and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That the development to which this permission relates shall be begun not later than whichever is the later of the following dates: (a) the expiration of five years from the date of this permission; or (b) the expiration of two years from the final approval of the reserved matters, or, in the case of approval on different dates, the final approval of the last such matter to be approved. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the deposited plan reference 9437/010 and the attached specification and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification and deposited plan. Reason: In the interests of highway safety and convenience. That the dwellings shall not be occupied until the means of access between the land and the highway has been formed, laid out and constructed with 3.5 metres by 90 metres vision splays. Reason: In the interests of highway safety and convenience. That work be not commenced on the erection of any dwellings until the carriageways only serving the whole of that portion of the development under construction, have been laid out and constructed to the above mentioned specification, save for wearing course and kerbing. Reason: In the interests of highway safety, to provide protection of the subgrade and to ensure adequate clear running surfaces which will protect adjoining public highways from droppings of spoil, mud, etc. That no dwelling shall be occupied until the whole of the roads and footpaths shown on the layout plan accompanying the application, and all surface water drainage works, have been laid out and constructed in accordance with the Oxfordshire County Council Design Guide for Residential Roads and the specification for the construction of works for housing development in all respects to the satisfaction of the Local Planning Authority. Reason: In the interests of highway safety and convenience. That the dwellings shall not be occupied until the existing access to the site is permanently and effectively closed in accordance with a scheme to be submitted to and approved by the Local Planning Authority. Reason: In the interests of highway safety and convenience. That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order), no other means of access whatsoever shall be formed or used between the land and the highway. Reason: In the interests of highway safety and convenience. That the development shall provide a means of pedestrian access from the site to the adjacent footpath to the north. Reason: To ensure safe and convenient access for residents to local facilities That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing. Reason: In the interests of public health.
