Conditions / Refusal Reasons
That the development be carried out strictly in accordance with the particulars of the development contained in the application to seek permission for the development and the plan numbers 90181/930/WD1, 90181/930/SITE-DEV6/D, 90238/930/SK5/C, 90238/930/SK6/B, 90238/930/SK7/B, 90238/930/SK8, 90236/930/100/SK15/A, 90236/930/100/SK16/A, 90236/930/100/SK17/C, 90236/930/100/SK20/B and 90236/930/010/001 accompanying such application except as modified by conditions of this permission unless otherwise agreed by the Chief Planning Officer in writing. Reason: To ensure the details of the development are carried out in accordance with the application as approved. That development must be begun not later than the expiration of five years beginning with the date hereof. Reason: By virtue of the provisions of Section 91(1)(a) of the Town and Country Planning Act, 1990. That the trees on the site which are to be retained shall be protected during building operations in accordance with the written requirements of the Chief Planning Officer. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality. As from the date of grant of this permission no trees shall be topped, lopped or cut down and no shrubs or hedges shall be cut down unless approval has been granted by this permission, without the prior consent in writing of the Chief Planning Officer and no site clearance shall start until any trees which the Chief Planning Officer requires to be retained are protected. Reason: To ensure drainage details are satisfactory and to avoid pollution. That the land be landscape and planted with trees and shrubs in accordance with a comprehensive planting and landscaping scheme first approved by the Chief Planning Officer and that trees and shrubs so planted be properly maintained and that in the event of any of the trees or shrubs dying or being seriously damaged or destroyed within a period of five years from the completion of the development a new tree or shrub or equivalent number of trees or shrubs as the case may be, be planted and properly maintained in a position or positions as first approved by the Chief Planning Officer. Reason: To enhance the amenities of the area. That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is the sooner. Reason: To enhance the amenities of the area. That the comprehensive landscaping scheme referred to in condition 5 shall be submitted for approval within 3 months of the commencement of the development. Reason: To enhance the amenities of the area. That no development shall take place until a professionally competent archaeological organisation, as approved in writing by the Chief Planning Officer in consultation with the County Archaeologist, has been commissioned to carry out a full watching brief during the period of construction works. The watching brief shall preserve by record any archaeological features which may arise in the course of works and shall include limited archaeological excavation where necessary and the retrieval of artefactual evidence. Reason: To safeguard the recording and inspection of matters of archaeological importance on the site. No trees are to be removed in advance of any contract for the phase of construction that requires their removal, having been signed by all parties. Reason: To ensure the protection of trees on the land and to preserve the amenities of the locality. That no soakaways shall be constructed such that they penetrate the water table. Reason: To prevent pollution of ground water. That a detailed scheme for all foul and surface water drainage works shall be submitted to and approved in writing by the Chief Planning Officer prior to the commencement of the development. The scheme shall make provision for surface water from roads and vehicle parking areas to be discharged via deep seal trapped gullies, but to finish in deep seal trapped gullies having a water seal of 85mm or similar.` Reason: To ensure drainage details are satisfactory and to avoid pollution. That the building shall not be occupied until the car park has been completed in accordance with the approved plans. Reason: To ensure that adequate car parking provision is made. That samples of the exterior materials proposed to be used shall be submitted to and approved in writing by the Chief Planning Officer prior to the start of work on the site. Reason: To ensure the materials are compatible with the surrounding development. No solid matter shall be deposited so that it passes or is likely to pass into any watercourse. Reason: To prevent pollution of the water environment. Surface water from car parking areas should be passed through a suitable type of oil-grit separator. To prevent pollution of the water environment. No conditions.
