Conditions / Refusal Reasons
That notwithstanding any indications as to these matters which have
been given in this application, no development shall be started
until full details of the following have been submitted to, and
approved in writing by, the Local Planning Authority:-
the siting, layout and number of buildings and the means of access
thereto;
the plans and elevations of all buildings;
the colour and type of facing materials to be used for the external
walls and roofs;
the provision to be made on the site for the garaging and parking of
motor vehicles in accordance with the Local Planning Authority's
approved standards;
a scheme for the landscaping of the site including the planting of
live trees, the treatment of forecourts and driveways, and the
provision of boundary fencing and screen walling.
Reason: As the application is in outline only and not accompanied
by detailed plans.
That application for approval of the reserved matters referred to in
Condition 1 above shall be made to the Local Planning Authority not later
than 3 years from the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the development to which this permission relates shall be begun not
later than whichever is the later of the following dates:
(a) the expiration of five years from the date of this permission; or
(b) the expiration of two years from the final approval of the reserved
matters, or, in the case of approval on different dates, the final
approval of the last such matter to be approved.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the development shall not commence until the use of the Eagle
Public House as a public house has ceased. The public house use shall
not thereafter be resumed.
Reason: In the interest of highway safety and convenience and to
protect local amenities because insufficient provision for
car parking would remain for the public house.
That the parking provision shall be as shown on the deposited drawing,
reference 01B all constructed, surfaced and laid out, retained
and maintained to the satisfaction of the Local Planning Authority.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities.
That the dwellinghouse shall not be occupied until the means of
access between the land and highway has been formed, laid out and
constructed, including the creation and maintenance of a vision
splay of 2 metres by the length of the site boundary to the south
east.
Reason: In the interests of highway safety and convenience.
That a public right of way linking Chequers Place with Ilges Lane shall
be constructed and laid out as shown on the deposited drawing
reference 01B prior to the first occupation of the dwellings hereby
permitted and shall thereafter be retained at all times for public use.
Reason: To protect local amenities.
