Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced. Reason: To safeguard the character of the area. That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary walling and screen fencing, including the provision of 1.8 metre high close boarded fences along the whole of the north-eastern boundary of the site with 21, 23 and 25 Baskerville Road and along the whole of the south-eastern boundary of the site with 26, 28, 30 and 32 Crowsley Way, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help assimilate the development into its surroundings. That prior to the commencement of any other development to which this permission relates, all means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience. That prior to the first use of the access road serving plots 4-7 (inclusive) the existing vehicular access road off Crowsley Way, which serves the garage court, shall be permanently and effectively closed in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority which shall include the reinstatement of the public highway, footway, verge and kerbline. Reason: In the interests of highway safety and convenience. That no dwelling shall be occupied until space has been laid out within its curtilage for vehicles to be parked as shown on drawing no. 243/10B; and such parking space shall be retained thereafter. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities. That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) private garages shall not be erected except in accordance with this application. Reason: To ensure satisfactory comprehensive development. That the garage accommodation shall be retained as such and shall not be adapted for living purposes unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities. That prior to the demolition of 31 Baskerville Road samples of the materials to be used for the making good of the north east (side) elevation of 33 Baskerville Road shall be submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory. That surface water shall not be disposed of other than in accordance with a detailed surface water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health.
