Conditions / Refusal Reasons
That approval of the details of the siting, design and external appearance of the clubhouse and car park (hereinafter called the "reserved matters") shall be obtained from the Local Planning Authority in writing before any development is commenced. Reason: As the application is not accompanied by details of these matters. That plans and particulars of the reserved matters referred to in condition 1 hereof, relating to the siting, design and external appearance of the clubhouse and car park, shall be submitted to and approved in writing by the Local Planning Authority and shall be carried out as approved. Reason: As the application is not accompanied by details of these matters. That application for approval of the reserved matters shall be made to the Local Planning Authority before the expiration of three years from the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That the development hereby permitted shall be begun either before the expiration of five years from the date of this permission, or before the expiration of two years from the date of approval of the last of the reserved matters to be approved, whichever is the later. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That except as may be otherwise agreed in writing by the Local Planning Authority the development hereby permitted shall be carried out strictly in accordance with (i) the Soil Handling Report accompanying the letter dated 22 September 1993 from Messrs Kemp Hankinson to the Local Planning Authority, and (ii) drawing nos. 2004.1.1A, 2A, 3A, 4, 5A, 6, 7A, 8A and 9 accompanying the letter dated 17 September 1993 from Messrs Kemp Hankinson to the Local Planning Authority, as amended by drawing no. 2004.1.23 accompanying the letter submitted on 28 October 1993 to Oxfordshire County Council. Reason: To ensure satisfactory comprehensive development. That no development in respect of the clubhouse building and car park hereby permitted shall take place until a schedule of materials and finishes for the external walls and roof of the clubhouse building and the surfacing of the car park and other hard surfaces has been submitted to and approved in writing by the Local Planning Authority, and only those approved materials and finishes shall be used. Reason: To ensure that the details of the development are satisfactory. That no development in respect of the clubhouse building and car park hereby permitted shall take place until a scheme for the external lighting of the clubhouse building, car park and access road has been submitted to and approved in writing by the Local Planning Authority; and external lighting shall only be provided in accordance with the approved scheme. Reason: To ensure that the details of the development are satisfactory. That the clubhouse building hereby permitted shall not be occupied until at least 18 holes of golf have been completed and made available for play. Reason: To ensure satisfactory comprehensive development. That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a scheme of landscaping, which shall include a schedule of all earthworks, the planting of a hedge of mixed indigenous species behind the vision splays referred to in condition 18(i) hereof, indications of all existing trees and hedgerows on the land, and details of any to be retained, together with measures for their protection in the course of development. Reason: To protect local amenities. That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the first use of or the completion of the first 18 holes of golf, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be identified in a schedule which shall be submitted to the Local Planning Authority before the end of each September, and shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To help to assimilate the development into its surroundings. That except as may be otherwise agreed in writing by the Local Planning Authority, all trees, shrubs and hedges on the land shall be retained and protected in accordance with the approved landscaping scheme during the course of development and for a period of 5 years following the completion of the development; and any trees, shrubs or plants which within that period die, are removed or become seriously damaged or diseased shall be identified in a schedule which shall be submitted to the Local Planning Authority before the end of each September, and shall be replaced in the next planting season with others of a similar species and of a size to be agreed in writing by the Local Planning Authority, unless the Local Planning Authority gives written consent to any variation. Reason: To safeguard the character of the area. That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a scheme for the management of the retained and proposed trees, shrubs and hedges, and of the proposed areas of scrub, rough and semi-rough; and these shall thereafter be managed in accordance with the approved scheme unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interest of nature conservation and wildlife. That no development shall commence until the applicant has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation to be submitted to and approved in writing by the Local Planning Authority. Reason: To safeguard the recording and inspection of matter of archaeological importance on the site. That no development in respect of the clubhouse building and car park hereby permitted shall take place until a detailed scheme for the disposal of surface water has been submitted to and approved in writing by the Local Planning Authority; and the clubhouse building and car park shall not be occupied or used until surface water drainage works have been completed in accordance with the approved scheme. Reason: In the interests of public health and to avoid pollution. That soakaways must not penetrate the water table and shall not be constructed to a depth exceeding 3 metres below existing ground level. Reason: To prevent pollution of groundwater. That new water features shall be off-line of the existing watercourse. Reason: To prevent pollution of the water environment. That no development in respect of the clubhouse building hereby permitted shall take place until a detailed scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority; and the clubhouse building shall not be occupied or used until foul drainage works have been completed in accordance with the approved scheme. Reason: In the interests of public health and to avoid pollution. That prior to the commencement of any other development hereby permitted (i) the means of access between the site and the Class 3 Road (C201) shall be constructed with 4.5 metres by 160 metres vision splays, 10 metres junction radii, and the first 20 metres of the access road being 6 metres in width in accordance with a detailed scheme to be submitted to and approved in writing by the Local Planning Authority, and (ii) the improvement works shown on drawing no. 6088/2 i.e. the widening of the Class 3 Road (C201), the provision of two passing bays and the improvement to forward visibility shall be completed in accordance with a detailed scheme to be submitted to and approved in writing by the Local Planning Authority. Reason: In the interest of highway safety and convenience. That the clubhouse building and golf course shall not be occupied or brought into use until the junction between the Class 3 Road (C201) and the A4074 has been improved and constructed with 9 metres by 215 metres vision splays and a ghosted right turning lane to the Department of Transport's standard TA20/84 in accordance with a detailed scheme to be submitted to and approved in writing by the Local Planning Authority. Reason: In the interest of highway safety and convenience. That the clubhouse building or golf course shall not be occupied or brought into use until parking space for 160 cars and a service vehicle has been laid out in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority; and the parking space shall thereafter be kept permanently available for the use of employees and visitors. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities. That no development shall commence until a scheme for the closure of all existing means of vehicular access between the site and the highway has been submitted to and approved in writing by the Local Planning Authority; and except as may otherwise be agreed in writing by the Local Planning Authority the approved scheme shall be implemented before the clubhouse building or golf course is brought into use. Reason: In the interest of highway safety and convenience. That no development shall commence until a scheme for the siting and design of the means of access to be used by construction traffic has been submitted to and approved in writing by the Local Planning Authority; and access for construction traffic shall only be provided in accordance with the approved scheme. Reason: In the interest of highway safety and convenience. That no development shall commence until a detailed master plan and written statement has been submitted to and approved in writing by the Local Planning Authority, following consultation with the Ministry of Agriculture Fisheries and Food. (i) The master plan shall indicate existing contours, proposed contours, greens, tees, bunkers, lakes, fairway mounding, car parks, access routes during construction, and other hard development or engineering works. No earth moving or engineering works associated with the development of the site shall be carried out outside the areas marked on the approved master plan; (ii) the written statement accompanying the master plan shall provide details of the proposed means of handling and moving soils and of the conditions under which the movement will take place in order to minimise damage to the structure of the soils. The statement shall confirm that: (a) No topsoil or subsoil shall be removed from the site. Approval shall be obtained from the Local Planning Authority, following consultation with the Ministry of Agriculture Fisheries and Food for soil or soil making material to be brought onto the site. (b) Soils shall be handled in a dry and friable manner. (c) Topsoil and subsoil shall be stripped, stored and reinstated separately and not mixed. (d) Soil storage mounds and other bare soil areas shall be sown with grass as soon as possible and any injurious weeds shall be controlled. Reason: To safeguard agricultural land. That the developer shall notify the Ministry of Agriculture Fisheries and Food at least a week in advance of the commencement of development, and permission shall be granted to the Ministry of Agriculture Fisheries and Food to enter the site to inspect the works at any time. Reason: To safeguard agricultural land. That on the completion of each of the first and second 18 holes of golf hereby permitted a plan and statement indicating the soil profile of all areas which have been subject to disturbance shall be submitted to and approved in writing by the Local Planning Authority following consultation with the Ministry of Agriculture Fisheries and Food. Reason: To safeguard agricultural land. That no construction or earth moving works shall be carried out on land to the east of Jacksons Lane (Bridlepath No. 15) before 0700 hours on weekdays and Saturdays nor after 1900 hours on weekdays and Saturdays, nor at any time on Sundays or bank holidays. Reason: To safeguard the amenities of local residents. That no maintenance machinery driven by an internal combustion engine or engines shall be used on land to the east of Jacksons Lane (Bridlepath No. 15) before 0700 hours on weekdays and Saturdays nor after 1900 hours on weekdays and Saturdays, nor at any time on Sundays or bank holidays. Reason: To safeguard the amenities of local residents. That no extraction and export of sand and gravel or other mineral shall take place from the site. Reason: In the interest of highway safety and convenience and to safeguard the amenities of the local residents. That no waste materials shall be imported to the site for any purpose whatsoever. Reason: In the interest of highway safety and convenience and to safeguard the amenities of local residents.
