Conditions / Refusal Reasons
That the proposed development would be contrary to the general,
environmental/countryside and housing policies of the approved Structure
Plan for Oxfordshire (particularly policies G1, EN1, EN4 and H1) and the
Council's adopted Rural Areas Local Plan (particularly policies G1, G3,
C8, H4, H5 CON1, CON4 and CON16) and approved South Oxfordshire Local Plan
(particularly policies G1, G3, G5, C3, H5, H6, CON8, CON15 and CON20).
The development does not constitute strict infill and would result in an
undesirable built intrusion and an intensification of existing loose-knit
development in an important open and spcious area on the edge of the
small settlement of Sonning Eye which would be detrimental to the character
and appearance of the area which lies within the Sonning Eye Conservation
Area and an Area of Great Landscape Value. The applicant's justification
does not warrant any departure from the planning policies of the Local
Planning Authority.
That the site comprises an important open and spacious area which is
important to the character of the Sonning Eye Conservation Area within
which the site lies. The development, by virtue of the size and siting of
the proposed dwellinghouse and the proposed continuous and high walled
enclosure of the land, would be obtrusive and detract from the character
and appearance of the Conservation Area. The proposed siting of the wall
would also result in the loss or long term damage to trees on the adjacent
car park and, therefore, would have a detrimental impact on the appearance
and character of the Conservation Area. As such the proposal would be
contrary to the provisions of the Council's adopted Rural Area Local Plan
(particularly policies G5, CON1 and CON2) and approved South Oxfordshire
Local Plan (particularly policies G8, CON8, CON10 and CON15).
That, having regard to the ground area coverage of the proposed
dwellinghouse and garage and to its location within the River Thames flood-
plain, the development would impede the flow of floodwater and reduce the
flood storage capacity of the floodplain and, as a result, would be at
direct risk from flooding and would increase the risk of flooding
elsewhere. As such, the proposal would be contrary to the provisions of
the Council's adopted Rural Areas Local Plan (particularly policy G9) and
approved South Oxfordshire Local Plan (particularly policy G16).
That, by virtue of the siting of the proposed garage within 3 metres of a
public foul sewer, the development would be likely to result in damage to
that sewer. As such, the proposal would be likely to have an adverse
effect on the environment and public health, contrary to the Council's
policies, in particular policy G7 of the approved South Oxfordshire Local
Plan.
That the development, by virture of the position of the proposed frontage
wall, would not provide the means of access between the site and the
highway with adequate visibility to the south of the site. As such, the
proposal would result in conditions prejudicial to the safety and
convenience of highway users, contrary to the provisions of the Council's
adopted Rural Areas Local Plan (particularly policy G7) and approved South
Oxfordshire Local Plan (particuarly policy G10).
