Conditions / Refusal Reasons
That the erection of a dwelling and surrounding earthbanks would be
contrary to the general, countryside/environmental and housing
policies of the approved Oxfordshire Structure Plan (particularly
policies G1, EN1, EN4 and EN7), the Council's adopted Rural Areas
Local Plan (particularly policies G1, G3, C1, C7 and H5) and the
Council's approved South Oxfordshire Local Plan (particularly policies
G1, G5, C1, C2 and H6) in that the dwelling would consolidate this
sporadic group of dwellings in the open countryside outside of, and
unrelated to, any settlement. As such the dwelling, embankments and
residential use of the site would detract from the rural and open
character of the site to the detriment of the character and
appearance of the area which lies within the Chilterns Area of
Outstanding Natural Beauty. The justification provided in the
application is not sufficient to warrant a departure from the
planning policies of the Council.
That the proposal would generate additional turning movements at the
junction of the lane/layby and the A4074 impeding the free flow of
traffic which would be detrimental to the safety and convenience
of users of the highway. The development would, therefore, be contrary
to policy T16 of the Oxfordshire Structure Plan,policy G7 of the
Council's adopted Rural Areas Local Plan and policies G10 and H11(iii)
of the Council's approved South Oxfordshire Local Plan.
That having regard to the limited width of the access track, which is
a road used as a public path (RUPP), the proposal would generate
additional vehicular movements along the access track, from the
A4074, to the detriment of the safety and convenience of other
users of the track particularly pedestrians, cyclists and
horseriders. As such, the proposal would be contrary to the
Council's adopted Rural Areas Local Plan, in particular policy G7,
and approved South Oxfordshire Local Plan, in particular policy G10.
