Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five
years beginning with the date of this permission and if this condition
is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That prior to the commencement of any other development to which this
permission relates, all means of access between the land and the highway
shall be formed, laid out and constructed strictly in accordance with the
specification of the means of access attached hereto, and all ancillary
works therein specified shall be undertaken strictly in accordance with
the said specification.
Reason: In the interests of highway safety and convenience.
That the vehicular accesses hereby permitted shall not be used until
the existing vehicular access has first been permanently and
effectively closed and the public highway verge reinstated; and
within twelve months of the commencement of the development a hedge
of the same species as the existing roadside hedge shall be planted
across the former vehicular access and such hedge shall be so tended
as to grow to and remain at a height of not less than 1.5 metres;
and any hedge plants or trees which within a period of 5 years from
the completion of the development die, are removed or become
seriously damaged or diseased shall be replaced in the next planting
season with others of similar size and species, unless the Local
Planning Authority gives written consent to any variation.
Reason: In the interests of highway safety and convenience, to help
to assimilate the development into its surroundings and to
safeguard the character and appearance of the Chilterns
Area of Outstanding Natural Beauty.
That except insofar as may be otherwise agreed in writing by the Local
Planning Authority, all trees, shrubs and hedges on the land shall be
retained and protected during the course of the development and for a
period of five years following the completion of the development. Any
trees, shrubs or plants which within that period die, are removed or
become seriously damaged or diseased, shall be replaced in the next
planting season with others of a similar size and species, unless the
Local Planning Authority gives written consent to any variation.
Reason: To safeguard the character of the area.
That a scheme for the landscaping of the site, including the planting
of live boundary hedges, trees and shrubs and the provision of `
boundary fencing shall be submitted to and approved in writing by
the Local Planning Authority prior to the commencement of the development
hereby permitted. The scheme shall be implemented as approved within 12
months of the commencement of the approved development and thereafter be
maintained in accordance with the approved scheme. In the event of any
of the trees or shrubs so planted dying or being seriously damaged or
destroyed within 5 years of the completion of the development, a new tree
or shrub or equivalent number of trees or shrubs, as the case may be,
of a species first approved by the Local Planning Authority, be planted
and properly maintained in a position or positions first approved by the
Local Planning Authority.
Reason: To help assimilate the development into its surroundings.
That no part of the car park shall at any time be used for the
reception or storage of materials to be recycled.
Reason: The use of the car park for this purpose would result in
additional traffic movements using a sub-standard access
which would be detrimental to the safety and convenience of
users of the highway.
That the car park shall not be provided with any form of lighting.
Reason: To protect the rural character and amenity of the area which
lies within the Chilterns Area of Outstanding Natural Beauty.
