Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990. That the use of the building shall be limited to the uses defined in Classes B1(a) and B1(b) of the Schedule of the Town and Country Planning (Use Classes) Order 1987 and for no other purpose whatsoever, unless otherwise agreed in writing by the Local Planning Authority. Reason: To safeguard the character of the area. That the development shall be carried out strictly in accordance with the description of the development, plans and specifications contained in the application, subject to the amendments referred to above, and subject to the conditions hereby imposed. Reason: To secure the proper planning of the locality. That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the external walls and roofs. Reason: To ensure that the details of the development are satisfactory. That development shall not begin until a detailed specification of the type, design and external finish of all windows, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory. That development shall not begin until a detailed specification of the type, design and external finish of all rooflights has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory. That bonnet tiles shall be used in the construction of the roof hips to the satisfaction of the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory. That development shall not begin until ventilation details have been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory. That development shall not begin until details of the natural stone wall along the frontage of the site have been submitted to and approved in writing by the Local Planning Authority, such details to include the use of traditional mortar (in accordance with drawing ref. 3664/19). Reason: To ensure that the details of the development are satisfactory. That a scheme for the landscaping of the site, including the planting of live trees and shrubs and the treatment of the access road and hardstandings, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings. That except insofar as may be otherwise agreed by the Local Planning Authority, all trees, shrubs and hedges on the land be preserved and properly maintained and that in the event of any of the trees dying or being seriously damaged or destroyed, a new tree or equivalent number of trees, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To safeguard trees which are visually important. That the existing trees on the land shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development. Reason: To safeguard trees which are visually important. That details of surface water drainage of both the parking areas and new building shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of public health. That prior to the occupation of the premises, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification. Reason: In the interests of highway safety and convenience. That the existing eastern vehicular access be not used and be closed by the erection of a 1.2m stone wall (as requested by condition 9) in all respects to the satisfaction of the Local Planning Authority. Reason: In the interests of highway safety and convenience. That the parking provision shall be as shown on the deposited drawing, reference 3664/10B all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities. That development shall not begin until details of cycle parking have been submitted to and approved in writing by the Local Planning Authority. Reason: To secure the proper planning of the locality. Before the development is commenced a detailed site investigation shall be carried out to establish if the site is contaminated, to assess the degree and nature of the contamination present, and to determine its potential for the pollution of the water environment. The method and extent of this investigation shall be agreed with the Local Planning Authority prior to commencement of the work. Details of appropriate measures to prevent pollution of groundwater and surface water, including provisions for monitoring, shall then be submitted to and approved in writing by the Local Planning Authority. Reason: To secure the proper planning of the locality. That a buffer zone as shown on plan ref 3664/18A, alongside Cuttle Brook shall be retained and maintained to the satisfaction of the Local Planning Authority. Reason: To provide undisturbed refuges for wildlife using the river corridor. That the building shall not be occupied until a lagoon has been created in accordance with details to be submitted to and approved in writing by the Local Planning Authority. Reason: To secure the proper planning of the locality. That there shall be no raising of existing ground levels anywhere on the site unless otherwise agreed in writing by the Local Planning Authority. Reason: To prevent the increased risk of flooding due to impedence of flood flows and reduction of flood storage capacity. That the ground floor slab level of the building shall not exceed 64.00m above Ordnance Datum. Reason: To safeguard the character and appearance of the Thame Conservation Area. That development shall not begin until details of all external lighting shall be submitted to and approved in writing by the Local Planning Authority. Reason: To secure the proper planning of the locality.
