Conditions / Refusal Reasons
An assessment of the available evidence, on the balance of probability, supports the conclusion that the application building known as 'Paddock Lodge', together with its associated garden and outbuildings has been used as a separate and self-contained residential dwelling for a continuous period exceeding 4-years prior to the application date. This use is therefore immune from enforcement action under section 171B(2) of the Town and Country Planning Act 1990 ('the Act') and must be regarded as lawful within the meaning of section 191 of the Act.
Appeal
No appeal lodged.
